To Paul Anderson, Lakeville Ma. 02346 <br /> On 14 Sept. 1977, t was called to the attention of <br /> the Board of Health of the 'down of Mashpee that the site <br /> of the Chop N' Block on Route 130 in Mashpee was being <br /> used as a ItDump stump.11 The Board of Health on this date <br /> issued a cease and desist order under Chapter 111 Section 150A <br /> of the General Laws and the Regulations for the Disposal <br /> of solid waste by Sanitary Land Fill. The order set the <br /> date of compliance as of 28 Sept. 1977. The Chop N I Block <br /> complied with the order, compacting and covering before <br /> 28 Sept. 1977• <br /> On 19 Oct. 197 " however, Mro Janes Lebel of L.E.B. <br /> Company Enterprises, Inc. a eared in our office to <br /> bring to our attention that the Chop Nt B lock at this <br /> time was using its site as a 3tump Dump. We acquiant e <br /> him with our order of 14 Sept. 1977 and told him that w <br /> would take further act ion. <br /> We requested the guidance of Town Counsel for the <br /> proper actn to take. He lnfrmed us that he believes <br /> the Board of Health at the time of issuance of its order <br /> had exceeded its pow s because he believes that we may <br /> so act only when directed by the Dept, of Environmental <br /> Quality Engineers as an agent of that Dept. <br /> .
