Mhpee Zoning <br /> Board of Appeals Minutes <br /> October 8, 2003 <br /> is a reasonable request and since the variance was already granted in 1999, they are <br /> included to grant the same variance for the same reasons. Mr. Felson wants all things <br /> referenced in the 1999 variance to be the same. Marshall Brem moves to grant the <br /> variance. Richard Guerrera seconds the motion. All agree. So moved. <br /> Edwin Thomas; Requests a variance from Section 174-31 of the Zoning By-law in <br /> order to vary the lot size requirements under current zoning to deem the lot buildable on <br /> property located in an R-5 zoning district at 55 Payarnps Road(Map 59 Parcel 15) <br /> Mashpee, MA. <br /> Sitting: Marshall Brem, Richard Guerrra and Robert Nelson. <br /> Edwin Thomas represents himself at this hearing. He is seeking land space relief in order <br /> o have this lot deemed buildable. The lot is 1.13 acres and has enough frontage. It was <br /> purchased in 1990 and the current zoning is keeping Mr. Thomas from building on this <br /> lot due to the 80,000 minimum square footage in this district. There is a 3-bedroom <br /> house being proposed to be built on this lot once Mr. Thomas is able to sell it. The Board <br /> wants to enforce the 40foot front setback requirement from the temporary turnaround. <br /> Mr. Thomas says that is acceptable. Marshall Brun moves to grant a 49,078 square foot <br /> variance. Robert Delon seconds the motion. All agree. So moved. <br /> OTHER BUSINESS: <br /> Marshall Brem moves to accept the minutes from September 24, 2003. Richard Guerrera <br /> seconds the motion. All agree. So moved. <br /> Southport: Due to a lack of quorum, the Southport informal hearing by Attorney <br /> Dunning will have to be postponed until October 22, 2003. The Board would like to <br /> make them the first item of business due to the fact that so many people cone to these <br /> meetings there is a limited amount of space available in the lower level conference room. <br /> Mr. Nelson makes a.notion to adjourn the meeting.
