f
Mashpee Zoning
Board ofAppals Minutes
October 22, 2003
submits pictures and letters to the Board. After some discussion with Mr. Mills, Mr.
Nelson reads a letter from Mr. Sherman, Conservation Agent, into the record. (letter
attached). In summary, Mr. Weinstein has met the requirements f Mr. Sherman to this
point and has rectified the conservation issue. Mr. Nelson reads another letter from Mr.
Patrick, an abutter, who is in strong opposition but was unable to attend the rating. Mr.
Mills counters with the fact the Mr. Patrick himself is in violation ofseveral zoning
matters as well. There are several speakers in strong opposition to Mr. W inst in's
variance for the following reasons.
Bruce Shoemaker of 82 Taurus load mentions that Ir. Weinstein is big builder in
Mashpee and should have known his lot lines. He has strong opposition to this variance
and feels it should be denied.
Gerald Willett of 79 Tagus Road speaks in opposition. He speaks at length about how
Mr. Weinstein, who built his house, sent him a letter reminding him how important it was
to keep within his lot lines when installing his pool. why then is it ok for Mr. Weinstein
to disregard the law. He feels everyone should be held to the same standards, especially a
builder who knows better. He further states that he has no problem with the pool itself, h
just wants it placed where it should be placed.
Bill I undin of 67 Taurus Road discusses his wishes to install a pool. Mr. Lundin, who
is confined to a.wheelchair had hoped to install a pool in his yard for thereputic reasons
but is currently unable to do because of his lot and current zoning. If Mr. Weinstein is
granted a pool variance then he wants one too.
Carol Willett of 79 Taurus Road, also states her opposition to this variance. She feels
that Mr. Weinstein should not be allowed to go beyond the law.
Dose Arnold of 20 Gemini Road informs the Board that Mr. Weinstein, who awns all of
Great Hay Estates, is very strict about anyone trespassing on any of his property. She lets
the Board know that if ever a work truck for someone else is in front of any ofhis land,
he makes thein move the truck and is not very neighborly about it. She feels that is h
knows where his property liras are for something like that then he should surely know
where his own property lines are in his yard.
Mr. Regan opens the discussion to the Board. Mr. Brenn comments that the plan filed
with the building department is not accurate and feels this was not done in error. Mr.
Brenn will fitly deny this variance. After some discussion, Mr. Nelson concurs that the
variance should not be granted. Robert Nelson moves to deny the variance. Marshall
Brem seconds the notion. All agree. So denied.
L.
