Mashpee Zoning <br /> Board of Appeals Minutes <br /> 1 November 12� 2003 <br /> TOWN OF MASHP E <br /> Zoning Board of Appeals <br /> Minutes - Wednesday,November 12, 2003 <br /> THE TAPE IS NOT PARS*OF THE HEARING:IT IS FOR THE PURPOSE OF <br /> TR,4NSCRIPTION ONL <br /> The Mashp e Zoning Board of Appeals held Public Hearings on Wednesday,November <br /> 12, 2003 at 7:00 P.M. at the Mashpee Town Hall. vice Chairman James Regan and <br /> Clerk Robert Nelson were present along with Associate Members Marshall Brenn, Zella <br /> lienberry and Richard Guerrera. <br /> Mr. Regan opened the meeting at 7:00 p.m. <br /> The first order of business was a continuehearing: <br /> Taul uareia: Requests a variance from Sections 174-25-(1)(9) and 174-31 ofthe <br /> Zoning By-laws in order to construct, maintain and license a dock facility. The dock will <br /> extend 82 feet from the mean high water and will be 2 feet off the side property line on <br /> property located in an R43 zoning district at 108 Wading Place Road (Map 111 Parcel <br /> 1. 7) Ma hpee, MA. <br /> Sitting: Janes Regan, Marshall Brern and Robert Kelson. <br /> Devin Kirrane represents his clients Mr. and Mrs. Paul Squarcia. This matter has been <br /> before the Board since January 2003. Petitioner has attempted to build a dock and has <br /> submitted several sets of plans but has encountered much disapproval from most of the <br /> abutters in Bright Coves due to the length and/or position of the dock. There was <br /> initially a dock presented for 46 feet, then 87 feet and finally 82 feet which have also <br /> been approved by Conservation. Harbormaster Perry Ellis has not ob.eet d to these <br /> proposals either and Bels there is enough room for navigation. Mr. Felson voiced his <br /> opinion that "aesthetically he sloes not like it''. Frederick Viles, a resident of. right <br /> Coves presented intricate plans and models shoving how the boat traffic would be <br /> impacted as a result of the 82-foot dock. F. leas Boyd, Jr., an abutter and attorney for <br /> the Edward and Bonnie Skane said the proposed dock would be a safety hazard. Mr. <br /> Kirrane pointed out that the clock size was increased in order to accommodate ars existing <br /> mooring located belonging to the Skane . Most of the Bright Coves residents seemed to <br /> agree that if the dock were scaled back significantly the neighbors would be in <br /> agreement. Mr. Boyd indicated that the Skan' es would be in favor of a shorter dock and <br /> would be willing to move their mooring. Mr. Erie Peterson a direct abutter of the <br /> Squaroias and owner of 200 feet of shoreline, said the shorter slosh would severely <br /> impact his frontage because it would run parallel to the shore insteAd 9 extending out <br /> into the cove.
