Mashpee Zoning <br /> Burd of Appeals Minutes <br /> November 12, 2003 <br /> AND <br /> Warren E. Benson: Requests a variance from Section 174-31 of the Zoning By-laws <br /> seeking relief from the current setback requirements for the existing frontage, sideyard <br /> setback, frontyard setbacks and land space requirements in order to build a 23' x 59 ' <br /> new structure on property located in an R-3 zoning district at 130 Sunmerse Road (Map <br /> 105 Parcel Mashpee, MA. <br /> Sitting: James Regan, Robert Felson and Richard Guerrera. <br /> John Slavinsly represents the petitioners in the hearing. They are seeping a special permit <br /> And variance in order to tear don heir existing dwelling and rebuild a new Douse. <br /> They need a variance in order to build their proposed structure. There is currently a new <br /> septic system that will accommodate a 3-bedroom dwelling, however, Conservation has <br /> only allowed a 2-bedroom dwelling. Kathleen Robertson a direct abutter has some <br /> concerns over the fact that her parents house is right next door and this new structure will <br /> too close to their bedrooms. The Burd feels the petitioners are being reasonable and Mr. <br /> Mr. Felson moves to grant the Special Permit and the following variances: <br /> 66 feet for frontage requirements <br /> 17 feet for the front yard setback requirements <br /> feet on the northerly side yard <br /> 3 feet on the southerly side yard <br /> 28,300 square feet for land space requirement. <br /> Richard Guerrera seconds the motion. All agree. So moved. <br /> Paul and Linda Howell: Request a Special Permit under Section 174-20 of the Zoning <br /> By-laws in order to demolish an existing dwelling on property located in an R-5 zoning <br /> district at 8 Bounty Way Map 96 Parcel Mashpee. ILIA <br /> Sitting: Zella Elizenbeny, Richard Guerrera and Robert Felson. <br /> Arthur Kelly, builder represents the petitioners at this hearing. They are seeking a <br /> special permit in order to tear down the existing dwelling and put a nodular home there. <br /> The Board sees no problem with this proposal. Mr. Felson moves to grant the Special <br /> Permit. Zella Elizenberry seconds the notion. All agree. So moved. <br /> Robert and Colette Urenas: Request a variance under Section 174-31 of the Zoning <br /> By-laws in order to build a 34' x 24' garage and mudroom on property located in an R-5 <br /> zoning district at 8 Fairneny Way, Winslow Farms (Map 71 Parcel 11 Mashpee,ee, M . <br /> Sitting: Zella Elizenberry, Robert Felson and James began. <br />
