Ma tepee Zoning
Board of Appeals Minutes of March 12, 2003
Sitting; James Regan, Zella Elienberry and Robert Nelson
David Sandi of Cape & Islands Engineering represents Brit Benway for Bay Point
Realty Trust. Petitioner is seeking to build garage on a piece of land he owns that is 2,265
square feet and is currently uninhabitable. Mr. Benway needs a 9-foot variance in order
to do this. Mr. Sandi explains to the Board that this plot of land cannot hold a septic
system and the owner would life to put it to use as a private garage for either a boat or a
car. He lives across the street from the property in question. He proposes a single ear
garage with standard shingles. Mr. Nelson feels nothing can be granted without any
building plans. Additionally, there is some opposition with a neighbor Bearg Zopian of
18 Mnorscy Road. He feels this will change the feel of the neighborhood and does
not believe a Variance should be granted. Mr. Brenn feels that the taxes amount to o
per year and it is assessed for$4,200 and should not be buildable. Mx. Zopian told the
Board that he was offered this property for$2,200 and was told he could do nothing with
it. Now he feels that it is not right for Mr. Benway to be able to do something with it.
Mr. Regan explains that petitioner has the right to put up a large shed without any permit
needed and that nay not be as aesthetically pleasing as a garage. The Board would life
Mr. Benway to come back with building dans and work things out with the neighbors,
The Board moves to continue this to April 2 , 2003. All agree. So moved.
Cathleen Dauphinais: Requests a Special Permit from Section 174-2 B 2 of the
Zoning By-laws to permit use as a Delicatessen on property located in a C-2 zoning
district at 440 Lathan Ellis Highway flap 72 Parcel 87 Mashpee, MA.
Sitting: James Regan, Robert Nelson and Marshall Brenn.
Cathleen Iauphinais and Robert Cagoli are seeking a Special Permit to open a delicaf
at 440 Nathan Ellis Highway.
