f <br /> TOWN of MASHPEE <br /> Zoning Board of. peal <br /> Minutes - Wednesday, March 26, 2003 <br /> The Mashpee hp Zoning Board ofAppeals held Public Hearings on Wednesday, March 26, <br /> 2003 at 7:00 P.M. at the Mashpee Town Hall. vice Chairman James Regan and Clerk <br /> Robert Nelson along with Associate Members Marshall Breen, and Richard Guerrera <br /> were in attendance. Mashpee Building Inspector Russell Wheeler also attended the <br /> meeting. <br /> Vice Chairman James Regan opened tonight's meeting at 7:00 p.m. Mr. Regan asked for <br /> a vote to go into Executive Session regarding Chapter 39 Section 23B. Marshall Brem <br /> makes a notion to move into Executive Session and Richard Guerrera seconds the <br /> motion. <br /> Roll Call: Marshall hall rem ("I"), Richard Guerrera("I"), Robert Felson "I" and Jaynes <br /> E. Regan, III ("I"). <br /> Mr. Regan reads a list of continued hearings. <br /> John 1 11ancl: Requests a Special Permit under Section 174-25.1.9 ofthe ZoningBy- <br /> laws to replace 28 feet of an existing floating pier with a fixed pier on property located in <br /> an R-3 zoning district at 44 Barbary Circle (Map 96 Parcel 104 G) Mashpee, AVIA. <br /> Sitting: James Regan, Robert Felson and Marshall Brem <br /> Mr. John vaeeara of Falmouth Engineering represents the petitioner. Petitioner is <br /> seeking to replace 28 feet of his existing floating dock to a fixed pier. The pier i <br /> showing wear and is 20 years old. This will entail putting 4 new piles into the Mashpee <br /> River. Conservation and Harbormaster has approved this. Marshall Brem moves to grant <br /> this Special Permit. Robert Felson seconds the motion. All agree. So granted. <br /> Criteria will include 1-6 with the wording changed from "proposed pier" to "upgraded <br /> pier".
