Anderson,
the Health Agent, addressed to Thomas J & Therese M. O'Neill,, The letter
is .,ia yoiir fi les, Mr. Chairman Vm looking at a copy of it now, and- in that
particular letter, the -last,two ar ,graphs, or I should say the second last
a,ra,grthereof stated that ie addressee of the letter Thomas J. or
Therese M. ' fe ll request a, Pearing, that your Board would give such a.
hearing and that particular notice was given pursuant to Section 15.24 of
310 CNE, that is the Code of Massachusetts Regulations,,which is also known
as Title v of State Sanitary Cade, and in particular that hearing notice
that you have given in the letter, specified that the applicant or the addressee
had to give you notice within seven days of service of the order. I be-
lieve that this particular order was served on Mr. & Mrs. O'Neill by officer
Peary Elias,. T believe:it is., of the , Ma hp e Police Department on Mrs. Therese M.
o'Neill -at 1: 12 P.M. on July 5,, 1984, I further believe based upon my examination
of the records that within seven days of service of the notice that Mr. and
Mrs. O'Neill, through an agent of theirs, I believe it was their son, if I'm not
mistaken., requested this hearing and that this hearing i . being held in compliance
qothe requirements set forth. in Title V9 which I previously cited. The proceeding
to be followed at this hearing, is that the applica t, not the applicant, but
the addressee, the person to whom your order was addressed has an opportunity to
appear at this hearing, to give any cause whir the hearing notice, or the notice,
I should say, you sent, to that person should be rescinded, revoked, or modified
r in any way amended, altered or changed. And with that, Mr. Cha,i.nnan I would
inquire as t6 whether, or not, anyone here is present for the purpose of intro.
ducig or presenting any evidence to show cause why the order of the Board of
Health should be modified, orwith-drawn or amended, rescinded, revoked or in any-
way changed. Is there anyone here who desires to speak to this point?"
