<br /> comply with the things th at you were asked to do as far ago as last September, in
<br /> which you've been suggesting your r going to do. right along, in which. your attor-
<br /> neys have been suggesting that you're going to do-and which, all the evidence in-
<br /> dicates that you int rid to do,, but it just hasn't been done. So I think tbe Board
<br /> has really exercised a great deal of restraint thus far., you might view it as
<br /> harrassment, I view it as restraint,*that this Board has bent over backwexc.s to
<br /> prevent ham from coming to -you, Which could come to you if the Boyd did make
<br /> finding that this woes constitute a menace to health, The fines are very severe,
<br /> if y u go into court, ard the court fines you.'
<br /> Mrs. O'Neill: "I would not be truly alaimed if there were a. real problem, i would

<br /> TC: "You see the issue here is that have a. system that failed and all the various
<br /> experts who have looked at the system, all say the same thing, the system is in
<br /> failure, it .is not functioning the way that it should function, there's something
<br /> wrong with it. It must be replaced. The fact of the matter is that run of the
<br /> effluent is flowing on the ground when it's been viewed by the experts, or not,
<br /> is not rel.event the thing that's rete ent is that the system is malfunctioning.,
<br /> no working. I take it from, ghat you're saying that the Board should al Luntil
<br /> it flows over on the ground again before they do anything, 'well that just not the
<br /> way it works."

<br /> Board, to not- only prevent pollution,, but if it sees the real probability of
<br /> pollution to take steps ahead of time, before pollution sloes come into play. Where
<br /> was pollution of the enviro sent going on last September, l think everyone ac -
<br /> mwl.edges that fact and that there hasn't been any effluence running on the ground.,
<br /> nonetheless the system is less than one foot below the water table, or above it I
<br /> should say, not bellow it, and this in itself constitutes a violation of the State
<br /> Sai.,litry Code.,' for a. good reason and if I'm not mistaken the reason is that if
<br /> you don't get up above Four Feet above the water table you're going to encounter
<br /> problems, when you get into periods of high water table act vity, such as we have
<br /> now, you're going to have a system that is going to fail that's number one
<br /> number two l believe there's no possibil.ty of sandy soil types filtering out, material
<br /> that is contained within sewar .ge effluent, rhich is normally found in all house-
<br /> hold effluent. The purpose of that four* foot level is to ensure that there is some
<br /> cleansing that takes place of the effluent, a.ssit preol.ates downward and penetrates
<br /> into thewater tablq and these two thing combin d I believe - axe the basis for
<br /> this four foot requirement of the State Sanitary Code, we don't have that yet, the
<br /> • Beard of Health is very concerned over it and they're also very concerned over your
<br /> private right, believe it or not, I know you don't think so, and know your
<br /> mother
