Y. <br /> TOWN OF MASHPEE <br /> Board of Appeals <br /> Minutes <br /> January 26, 1994 <br /> The Ma hpee Board of Appeals held a meeting on Wednesday, January <br /> 26, 1994 at 7:30 P.M. at the Mashpee Town Hall. Board Members <br /> Present were John J. Friel, Michael A, Ma unas and Edward M, <br /> ovoni . Building Inspector William Hauck was in attendance. <br /> Mr. Friel called the meeting to order at 7: 40 P.M. He explained i <br /> that the Board did not have a quorum for some of the hearings . <br /> Mr. Ma} unas said the Board had a quorum to open the meeting <br /> but did not have a quorum to Grote on some of the applications, <br /> Donald H. Priestley TR. -- Mr. Friel said there were six hearings <br /> which will be continued to February 9, 1994 . A member of the <br /> audience asked why stop work orders had been issued. Mr. Govoni <br /> answered that the Building Inspector had the opinion that the <br /> building permits had expired. <br /> Attorney Robert dills stated that he represented Mr. Priestley <br /> and the owner of the lots, Mr. DeMartino, and questioned if <br /> Ms . Hawer was planning to attend. Mr. Friel explained that <br /> she was not. <br /> Dream Develop Mr. Friel said these would be continued until <br /> February 9, 1994 . <br /> Frederick Blythe - Mr. Malunas explained that the special Permit <br /> had been appealed and Mr. Blythe ' s attorney received a favorable <br /> judgment on one part of the permit allowing- the dock but remanded <br /> the Permit because the masons for the decision needed <br /> clarification. He said the Decision had to be rewritten and <br /> i <br /> filed with the Town Clerk and it could be appealed again. <br /> Myles McHugh, an abutter, asked why the Permit was required <br /> and Mr. Friel explained that all docks have to have Special <br /> Permits. Mir. Makunas said the special Permit process required <br /> abutters be notified. Mr. Friel explained that they are <br /> i rewriting the Decision to be more specific. Attorney William <br /> Henchy, representing Mr. Blythe, reviewed the language of the <br /> Decision. Mr. Friel roved to accept the revised language. Mr. <br /> Mai unas seconded. All agreed. <br /> T. Edward ?ones - (Advisement from November 10, 1993 ) -Mr. Friel <br /> moved to grant the special Permit. Mr. Govoni. said he had <br /> reviewed the Deeds and agreed and seconded the motion. All <br /> agreed. Mr, Govoni said that Variances and special Permits <br /> had been granted for almost every property on Daniel ' s Island <br /> Road and that this property had two separate Deeds and that <br /> the lots had been separate on the Assessor ' s records . <br />
