Board of Health, Minutes, Meeting
Page 10
Continuation of ap2earance of Atty. Morris Kirsner
LCA: "Now which well are you?" i
F
Mr. "I 'm not even on there, that ' s the problem. "
CHL: "Well, we can't protect you if we don' t know you're there . "
Mr. K: "Alright, then my point is the engineer should have giver
you a more detailed plan. "
CHL: "This is a standard form Morris that comes in that all these
engineers do, we tell thein that they have to give us all the wells
that around there that a] utt an area -within a 100 Ft. radius.
Mr. K: He didn't do -it.
RFT : Which house is your house on Mr Kirsner,
Mr. K:
CFB: It doesn't show there .
LCA: I .can send Mr. Warwick a letter and ask him to measure from here
to here. indicating plan '
RFT: So 2 doesn' t ahutt 12 then?
CHL: 2 rust ahutt 12 , because 12 is a lona. . * , it looks like he has
picked up a piece of land that ways in between some lots, Chats what
it looks like.
LCA: Al right we can do that we can have Mr. Warwick give us those
measurements before and after._
CFB : I want to know why Warwick didn 't locate that other well.
CHL: Thats the only thing that I sit here acid agree with right now
withf.. Mr. Kirsner is that he wasn't represented on that plan.
Mr. K: Thats my whole point. Because I 'm quite sure, Kn9wing the
integrity of this hoard and their expertise and your experience,
that had you an awareness of the location of any well the least that
would have happened I mighthave been invited to come in and talk
about it, period. I didn 't cone her antagonistically, but I 'm very
j strong in any views. Ask him (Warwick) to 'male the measurements, and
then, may I make a suggestion? I think youought. to,really,
determine whether , the board, can, in the interest of approving a
system vary the 100 ft. minimum requirement without going to
i
DEQE first, because ause the law as I understand it is very clear.
CHL: We 've always done under the assumption that we didn't need
approval because of what they have said to us prior, only on new
construction
CFB : well no, what we felt we- had done was male it safer, for every-
one involved.
Mr. : I know it, that ' s what I said before, but actually that was
an intensification of it.
CHL : you feel that because of shorter footage there is ars intense-
ification, we don 't feel that way, we feel that because ause of the
system that was put in _that that system would give you more protection
than a cesspool sitting out there bubbling into your water system.
