TOWN OF WLWEE, BOARD OF HEALTH, MEETING, MARCH 2, 1987 Page six
FB. continues fluids from the 1 eac h i ung area. In other words that contairrpent way l l is there
o as to direct the leachate in a vertical direction, a pull down gravity direction and if it
weren't there then it would seen to rye that the thinking is that there could be a pss i b i l ity o
lateral f 1 ow without it spreading. If what you 1.re saying is that you be 1 i eve that the re-
taining wall should be moved-to the perirreter of the excavation site and have that all lined.
I see what you're saying. It looks i i ice you've got the containment wall ccrni ng out to within
three feet, four feet, of the side lot boundary to the south, It's coming out ten feet, fifteen
F feet of the road, taking ten feet or so on that side and going to the driveway on the other al-
rrrost to the excavated-area. Looking at the print it I going i nto the driveway or i nto the edge
of the driveway area and it's coming down to about fifteen feet of the paved surface of the road,
on the road side, I'm a little puzzled by the inside lines there*
OPS: Those are proposed elevations.
FB: It wou 1 d seem to me the road side of the wall is ten feet away f r n the 1 e ach i rig area,, the
other i s f i fte n to twenty, and on the d r i veway s i de you have about f i fteen feet f marry your l eaoh-
i ng area to the wall.
CHL: What's the prb 1 em, why can It we rove this one back toward the street more, your g of room.
OFB: I've got no objeoiton.
CHL: The only area I can see that you have is where abutting this line over here and that, when
the excavation is done that's up to the owner and excavator to be sure that they don't break
over that line , and the street way your -could pu l I mre this way and give yourself some more roar
in there, you know if ,your pu l l htat wall back towards the street, and give a variance that way,
they have to excavate anyway.
CFB:. Right, so it wouldn't make that much'difference, except in concrete, you aright be adding on
footage on either side.
JPS: Okay.
CHL: See chat I'm saying John' r ,
r
JPS: I'm not sure of the ramifications , sticking this wall out on the stmt.
OFB: Not on the stmt to the edge of the street.
CHL: You're not excavating onto the street are ,your?
JPS: The pavement, no, the suet right of way, yes.
Burgmann: How are ,your going to Deep it from going under the pavement,. you're excavating right up
o the pavement, and ,you've got a material theme that's got a two to one slope, you're go i ung to
have a tough.time unless you sheet it to keep it from f l urff i ng out from under, the pavement.
CIL. Well that's who owns 4that road.
JPS: I think he's going to have to put up some sort of a bond, or whomever does own that road,
any damage that's done is going to be replaced and repaired.
OHS.: I don't h i nk that's a Board of Health preb I em.
JPS: I don't think It is.
CHL.0 And on the side line I think ;that's the people .who are doing the work,, the excavator and
the Donaldls or whomever 1 i ve them, if these people.do damage to their lot them they have the
right to recourse, they should take all precautions to be sura they don't go over there or that
theme no cave ins that go into their property, but I can't go down there and hold their hams on
that, I don't think {that's up of this Board. I have no problem if your bring that wa l 1 back a
1 i tt 1 e bit, give a 1 i tt l e more breathing roan in there; -,you can bring that a l l fifteen feet i
you've going-back ten foot. See what I'! saying? The sideline issue is between the two parties,
as long as wegive him the variance to o up to his sideline, that's basically all we're doing.
PS: We're not asking for a variance to do that, we're not asking for a variance of any nature.
CHL: You're not putting a leacing field there and if theme is a cave in you people am mspons-
ible for it.
