<br /> Chair: No. not -really because it sags that the BOH may require, it doesn't say that the DOH must
<br /> require adn this is what we are now doing, we are saying 'we require.
<br /> O M: How soon do you plan to implenent thiWould it be this season?
<br /> Chair, It would not be for this season, it would be implemented the beginning of next season, I
<br /> think it would be unfair at this stage of the gaTe to turn to somebody next week. and say,, 'Hey
<br /> put a lifeguard in there.' As of January when all swimming pools , used by a group, have to be
<br /> inspected for the next years' use; we felt that by that time we would have notified everybody
<br /> f this r egulatibn and the implementation date, so that they would be aware of it when they went
<br /> to re-submit their pools.
<br /> d M: What size are the pools, regulation or what?
<br /> Cha 1r: It wou Id, in my eyes, depend upon the use of the pool, a small pool that is overcrowded
<br /> might be more dangerous than a large pool with a lot of space amund pe p 1 e.

<br /> W. Costa: Well what we had proposed that every twenty people in the pool, here shall be one
<br /> lifeguard, so that if them is 21 people ,you'd need 2 lifeguards.
<br /> UM: What if thea are 100 people?
<br /> Mr. Costa: One l i feguard for every 20 people.
<br /> Chair: The question of 100 people in the pool is probably mythical, because if You started to take
<br /> each time you put a pool into one of these units, ,you must give an estimate of the amount of people
<br /> that is using the pool. The State requires that -there be so many feet per person in the pool. It
<br /> would be the responsibility of the lifeguard on duty or the people responsible for the operation
<br /> to see that the m i n inn, the ma i ffun mount of peop 1 e allowed in the pool at any g i gen time wou l d
<br /> not be exceeded; each person in that pool must have X amunt of feet to use, you can't.stack them
<br /> up in it.
<br /> U M: As far as that my grandson was in there a couple of weeks ago and he had a couple of inner
<br /> tubes, is that, pem- issable or what'd -
<br /> Chair: I think that would probably be a regulation that we would rec mend that each pool operator
<br /> enforce, I don't, like to see it; if I were manager I would ask that it be removed and I would have
<br /> a sign up theme that n ifrming tubes are used in the pool, in a confined space like that they
<br /> can be dangerous. One of the things that could result in the conversations and-discussions we have
<br /> here this even i n is .that we could add other sect i ons to this regu l at i on further defining the use
<br /> of the pool and by whom and what conditions.. it would be difficult because we are talking this co
<br /> bination of home owner and more or less resort operated pools. I know them are pools, I carne
<br /> from Now York and I've been on duty down thea and thea are regulations that state that no child
<br /> shall be admitted to the apron of the pool unless accompanied by a responsible adult.
<br /> W. Costa; I think that Charlie covered that it would be the responsibility of the people who own
<br /> that pool that noone just drops their child off , an adult must be with the child.
<br /> Chair: If ,you're suggesting that the second section of section 2 reading CHILDREN UNDER AGE 1
<br /> etc*..to change that to will not and put that, up into section one, under a need for a lifeguard,
<br /> rather than having it attached to the warning that no,1 ife guard is on-duty. Then ,your suggestion
<br /> would be that children under age 1 , under section ons wi l 1 not use swimming pool without an adult
<br /> in attendance and thea under~ section two that a sign be posted that three children and no more, NO
<br /> MORE THAN THREE CHILDREN MAY DE BROUGHT BY ANY ADULT, so that we would have a constant .ratio of 3

<br /> of time when children are in the pool and adults are out,spec i f i ca 1 l y for the same reason that, it's
<br /> .hard to see a kid when there are adults 1n the pool.
