i <br /> 3 <br /> 13 m BOARD OF HEALTH <br /> • °w "� <br /> .477-1777 <br /> tAg C <br /> REGULATION FOR MASSAGE THERAPISTS AND ESTABLISHMENTS PROVIDING MASSAGE, VAPOR, <br /> POOL, SHOWER, OR OTHER BATHS. <br /> The following regulations are promulgated by the Board of Health of the Town of Mashpee under the <br /> authority of the Massachusetts General Laws, Chapter 140, Section 51-53: <br /> 1. LICENSE REQUIREMENT AND FEE: <br /> No person shall practice massage or conduct in any form, inividually, corporate or otherwise, <br /> an establishment for the giving of massage, vapor, pool, shower, or other baths for hire or <br /> reward, or advertize or hold himself/herself out as being engaged in the business of massage <br /> or the giving of such baths in the Town of Mashpee, without receiving a licence therefore from <br /> the Mashpee Board of Health. The licence fee for each establishment shall be $ 50.00 . The <br /> licence fee for each massage therapist shall be $ 25.00 . These licences are nontransferable <br /> and mut be renewed annually at the beginning ofyear. <br /> 2. DEFINITIONS: <br /> P For the purpose of these regulations: <br /> a. MASSAGE shall mean the manipulation or conditioning of part or parts of the body by manual, <br /> mechanical, or other means as a beauty treatment, for purported health or medical treatment, <br /> or for the purpose of envigoration. <br /> b. ESTABLIWENT FOR GIVING MASSAGE, VAPOR, POOL, SHDWER OR OTHER BATHS shall mean the office, <br /> place of business, or premises where massage is practiced or where therapeutic or condition- <br /> ing <br /> editioning baths of water, vapor or other substance are given. <br /> c. APPROVED shall mean approved by the Board of Health of the Town of Mashpee, in accordance <br /> with accepted standards. <br /> d. APPROVED COURSE OF M4SSAGE shall mean a course on the art and science of massage therapy <br /> which includes both theory and practice and is approved by the Board of Health of the Town <br /> of Mashpee, in accordance with accepted standards. <br /> e. MASSAGE THERAPIST shall mean a person, male or female, licensed to practice massage. <br /> 3. EXCEPTIONS AND EXCLUSIONS: <br /> For the purpose of these regulations: <br /> a. PERSONS EXCEPTED: Physicians, Chiropractors, Physical Therapists, School Athletic Trainers, <br /> or Podiatrists registered in the Camurvealth are excluded. A person registered as a barber <br /> or an apprentice under the provisions of Section 87H or section 871 of Chapter 112 of the <br /> General Laws or as a hairdresser or student thereof under the provisions of Sections 87T to <br /> 87JJ, inclusive, of said Chapter 112 of the Massachusetts General Laws may practice facial <br /> and scalp massage without taking out a licence. <br /> b. OTHER PERSONS EXCEPTED: A person licensed to practice massage therapy in any other city or <br /> Town in the Camunwealth may, upon written orders of a physician, attend to patients, <br /> specified by the physician, in the Town of Mashpee without being licensed in Mashpee. He <br /> shall, if requested, submit to the Mashpee Board of Health copies of his/her licence from <br /> another carmmity and the physicin's orders. <br /> b. ESTABLISHMENT EXCLUSIONS: Hospitals, Nursing Hares and Convalescent Hares and other similarly <br />
