r <br /> 4 <br /> MINUTES March 22, 1990 3 BOARD OF HEALTH <br /> Mr. Costa stated the moratorium cannot be lifted unti l <br /> water is flowing. <br /> Mr. Bonitatib s questioned Board members as to whether <br /> the Cape Cod Commission would directly affect the <br /> buildability of his lot. <br /> Nor. Costa stated it will not effect the buildable status <br /> of the lot. <br /> APPOINTMENT: Larry Hall -- Benchmark Engineering - Title <br /> Variance, lot 6A sant it Lame (Greenberg) <br /> Mr, Hall was in attendance for this scheduled hearing. <br /> There were no abutters in attendance. <br /> Mr, Miall presented certified mail receipts to the Board <br /> and stated the septic system is in failure. Perc tests en- <br /> countered water at 3411 to 3611 . A rounded system is proposed <br /> as breakout calculations for a level system would extend the <br /> retaining wall and the system beyond the property lines. Mr, <br /> Fall stated his client would provide a letter to this Board <br /> stating there will be no increase in habitable living space <br /> and the garbage disposal will be disconnected. Mr. Greenberg <br /> indicated prior to submitting the statement he is requesting <br /> confirmation by this Burd that the garbage disposal will not <br /> require removal . Mr. Ball reiterated his earlier comments <br /> stating the system is in failure and is contaminating sant it <br /> Pond, the proposed system is better than what is in. copies <br /> have been forwarded to Brian Ddley ,a D.E.P. who did recom- <br /> mend guidelines to follow. A tentative meeting is scheduled <br /> with the Conservation Commission and may require an E.I .R. <br /> report on the pond, as well as, a reregetation plan and land- <br /> scape plan. The existing well will be relocated, to an area <br /> less than 1001 from the proposed system and existing cess- <br /> pool , this relocation does represent an increase in footage <br /> over the existing well location, Mr. Hall commented this <br /> proposal is less polluting than the existing system. <br /> Mr, Costa stated he will require removal of the garbage <br /> disposal and stipulate no increase in habitable space, <br /> Mr. Hall did suggest approval by this Board with the <br /> stipulation monitoring wells are installed to ensure the sys- <br /> tem is functioning properly. <br /> ro McQuaid stated the owner could be required to peri- <br /> odically sample his well water. <br />
