TOWN OF MASHPEE I - BOARD OF HEALTH June 21 , 1990 Meeting called to order at 7;00 p.m. Members present: Stephen J. Greelish and George R. Costa. Mr. Doherty joined the meeting at 8:45 p.m.. . Warrants signed 2 , ) Mr. Costa motioned to accept the minutes of June 14 , 1990 , Mr. Greelish seconded. Mr. Costa motioned to accept the Executive Session min- utes of Jure 12, 199 , Mr, - Greelish seconded. At this time as Ms. Mills was in attendance Board members moved to #17 on the agenda. 17, ) Report by K, ..- V. Associates re: Mashpee River...Modeling Stud - Ms. Mills stated to the Hoard she would like to dis cuss an issue, as a► private citizen, regarding the use of a vacant building at the "Riverbend" . Ms, Mills stated, ,in her opinion, Mr. Halpern does not have the legal right to utilize the entire building for occupancy. At the present time there are people living within the building. . Mr. Greelish questioned whether the building has anoc- cupancy permit. Nis. Mills responded the building was abandoned for at least two years, if there was an occupancy it has since lapsed. Under the non-conforming law a structure once aban- doned for two years or more must conform to present zoning requirements. The structure was previously used, about twenty years ago, to house motel employees during the summer months. Since that time the structure has been used for storage. Through the years the plumbing was removed and used in other areas of the complex. Mr. Costa referenced Ms. Mills Letter of 1988 regarding the illegal use of the building. At that time this Board questioned the Building Inspector as to whether the structure was considered a pre-existing non-conforming use. The Board never received a response from the Building Inspector.
