k <br /> MINUTES August 16 , 1'990 2 BOARD of HEALTH <br /> Mr,. costa motioned to approve and sign the contract, Mr. <br /> Doherty seconded, all in agreement. <br /> Mr. Greelish stated that if the Commission decides ,i <br /> will review this matter, we will not require W & S to dupli- <br /> cate their work. <br /> . ) Copy of letter from K-v Associates to Mr. Halp ern,, Mr, <br /> Evans reminded -the Board that he had reviewed the draft <br /> Mashpee River study done by K- i on behalf of the Planning <br /> Board and informed this Board i prior to sending a memo to the <br /> P.B. that the studywasn't worth the paper it was written on, <br /> that the study was entirely seweda Mr. McQuaid added that <br /> Mr, Halpern had called this office recently asking if we had <br /> given -v the right to enter his property without his permis <br /> sion to retest some areas which showed high bacteria levels, <br /> to which he answered no. Mr. McQuaid stated that it appears <br /> that the Board of Health has been misrepresented, noting <br /> paragraphs 3 & 4 and the cc. , and that we have, never met with <br /> K-v as far as this study. <br /> Mr. Greelish instructed the agent to send a memo to the <br /> Planning Board, with copies to K-V and Mr. Halpern stating <br /> that this Board has severe reservations about the validity of <br /> the study, have commented to that effect to the P.B. and that <br /> we do not wish to be misrepresented as endorsing this study <br /> and that since such has been presented to Mr, Halpern, we <br /> wish to meet with the parties involved* <br /> Town our e l o f�n i on on M �r i f i re�s bu i l d i nn occu� <br /> p� ,restriction Mr.. Ic uaid relayed he met with Town <br /> Counsel regarding Mr.. Griffin's restriction* Town counsel is <br /> of the opinion the restriction is unenforceable, <br /> Mr, Doherty motioned to deny without prejudice Mr. <br /> Griffin's request for a variance based upon Town Counsel's <br /> recommendations, Mr. Costa secondeda all agreed, <br /> . "Swimmer's Itch" war'r"li - Mr, McQuaid informed the <br /> Board after conferring with Howard Wensley from . .P. and <br /> Stetson Hall. it wasreed warning should be posted a <br /> g* week, �..f <br /> Mashpee Beach. The yarning will a posted for one , <br /> no additional oases are reported to either this Board or the <br /> County Health Dept. the warnings will be removed, however if <br /> any additional oases are reported the beach will be closed. <br /> Board members concurred. 4 <br /> . variance re nest Red Brook Rd. � Mr, McQuaid ex- <br /> plained a variance is requested from owners well to butter's <br /> septic. <br /> L - - <br />
