MINUTES October 5, 1989 BOARD of HEALTH <br /> t <br /> is asking this Board -to approve a private weil for a commercial e ab.l i shment <br /> and put the burden on the Board to limit the occupancy to- twenty-five people, <br /> Mr. Ferragamo commented his understanding of the regulation in 'the <br /> Commonwealth is if a person owns a piece of real estate, when they own this <br /> iece of real . estate they are entitled to -c rt in things in the Commonwealth <br /> such as building upon that piece of real estate in compliance with applicable <br /> regulations. in this case the applicable regulations say that we can provide <br /> a source of potable water fo ran average of twenty--fire people per day. <br /> ti <br /> Mr. Costa stated he would like a letter of approval for the well form <br /> D.E.P. . This office does not have the staffing available to police the fac- <br /> ility. <br /> ac- <br /> ilit . <br /> Mr. McQuaid commented this Board has not received anything in writing <br /> stating what the proposed usage of the building will be, certain businesses <br /> equ i.re more water than what a private well ca.n provide. <br /> . Evans explained that sampling of a community water source is also <br /> required, there is no way in which to sample the quality of that water. <br /> 1r. Greelish stated he would support a temporary agreement however, <br /> D.E.P. approval would still be required. Mr. Greelish suggested some mech- <br /> anism <br /> ech- <br /> anism of enforcement_that could be used in the interim. <br /> Mr. Costa stated this Board wi l l abstain from signing-off on the bu i ld- <br /> ing permit and is reminded he is proceeding una�er Massachusetts Building <br /> Codes 70 CMR, sections 114.8 & 127.0. <br /> [fir. McQuaid stated plans submitted do not delineate M.D.C. separators <br /> and commented they are preferable over another type. <br /> Mr. Evans stated he would like to view floor plans for the food estab- <br /> lishment prior to construction. <br /> 9. ) Notice from Director of coastal Zone Management - The Board acknowl- <br /> edged <br /> cknowl- <br /> e ge receiving the notice. <br /> 10. Letter from SE ASS re: Minimum delivery obligation - The Board acknowl- <br /> edged <br /> c nowl-edged receiving the letter. <br /> 1 1 . ) Response form Weston & Sampson to D.E.P. re: Pilot study - The Board <br /> acknowledged ledged receiving the response. <br /> 12. ) Proposed 1990 fee schedule, resubmitted) Mr. Gree 1 i sh motioned to <br /> adopt the proposed 1990 fee schedule as submitted, Mr. Costa seconded, <br /> all agreed. (The 1990 fee scheudle is attached to the end of these <br /> minutes. <br /> 13. ) Seminar announcement "Environmental Impacts and Landscaping Practices" . <br /> October 25, 1989 - Mr. McQuaid requested to attend this seminar. <br /> The Board was in agnc . <br />
