Now what is allowable is 490,000 square feet and what <br /> is proposed is 677,000 square feet. what was allowed in terms of nitrogen loading <br /> was 1,865 pounds a year. The 19 34 agreement would allow 10,0 o pounds a year <br /> in nitrogen. This is their own documentation. This isn't anything they have cone <br /> up with. This is part ofthe environmental impact report. What has happened fere <br /> is as the result ofthe change in the special permit that took place in 1994. The <br /> amount of development that is allowable here has been incredibly magnified and <br /> shoe horned into an area that literally encircles our wells. He would agree there <br /> completely. He has not been trying to.sort of unfairly tcr�ic Never Seaury <br /> negotiating position. But, he thought he could fairly categorize by saying that the <br /> negotiating position is what is mine is mine and what is yours is negotiable. They <br /> have leen unwilling to do anything meaningful in terms of re-design ofthis <br /> development, which has put us in this position. The reason it has cone up <br /> quickly, by the way, is that the Cape Cod Commission process is that they hear <br /> this jointly with the environmental impact reports. The environmental impact <br /> report process has been ongoing for roughly a year and just got completed in <br /> December. That clicked the Cape Cod Commission's time clock. His request is <br /> simply that the BOH support. They need not take any formal action and they are <br /> not invoking a.hy regulatory jurisdiction. He is requesting the BDH's report by <br /> referral of the Conservation Commission of Section V to the Cape Cod <br /> Commission. <br /> Mr. Harrington stated that he was in agreement with the request. The BOH has <br /> very little jurisdiction as it is and unfortunately their role is going to happen when <br /> it is too late. The wells will already be impacted. his an enforcement agency the <br /> BOH doesn't have any type of regulations in place to stop this. The Cape Cod <br /> Commission at least has some armament to do that. We have none. <br /> Mr. Doherty said that the BOH members should move it. He'll entertain a notion. <br /> Mr. Santos made a motion to have the BOH issue a letter of endorsement to the <br /> Cape Cod Commission. Mr. Ball seconded. But, he didn't appreciate not having <br /> the opportunity t "chew on it." Motion passed. <br /> Mr. Hench said that he appreciated the support. They are starting their hearings at 3:00 PSI. <br /> OLD BUSINESS <br /> Great wall Consultant Contract <br /> Mr. Harrington Megan by stating that the Great Wall has provided the BOH the <br /> contract from M D. Consulting, Dr. San Wong, who did provide therm with their <br /> initial Sex-vSa.fe training hack in September and has now been contracted to <br /> provide services as ordered by the BOH. Ms. Cindy Chen called and suggested <br /> that the contract was rather restrictive now that they have read it and digested it <br /> although they were forced to enter the contract. They would life to discuss some <br /> limitations on the contract. <br /> 3 <br />
