property is not in Zone ll. It is a well that is driving the nitrogen loading
regulations. That was why the three-bedroom application was ioriginally
denied by the BOH. But, the BOH had given them the chance to start
building and not get occupancy until the town provided water. The
original applicants did not want to proceed in this manner, They asked
the board to deny it to get out of their purchase and sale, which he was
under the impression was ghat happened, That was why Mr. Lu kcraft
was here tonight. All that is being proposed right now is a one-bedroom
dwelling. The septic is staying the same as the minimum required for
three-bedrooms, But, again they could make the conditions as far as
occupancy.
Mr. Ball reiterated that he was only doing orae-bedroom. Why would they
make the conditions if it were only going to be one-bedroom?
IVIr. Harrington replied that ultimately Mr. Luckcraft was going to want
three-bedrooms in the house.
IVIS. Warden stated that it would be an affidavit that the hone would be a
one-bedroom until such time as'torn grater is provided, Then it could
become a three-bedroom home.
Mr. Harrington stated that the abutter to the south is 1091 from the septic
and they were going to connect up to town water. He had already .
discussed this with the abutter.
Mr. Santos stated that since this was new construction didn't the
abutters have to be notified.
Ms. Warden replied that they didn"t have to notify abutters because it
was a local regulation. The 1001 regulation was a state regulation;
Mr, Harrington reiterated that they were not less than 7 001.
IVIS. Warden continued by stating that the town's was 1501 and you only
have to be notified if it under 1001.
Mr, Santos reiterated that they were corning in under our regulation.
IVIS. Warden replied that it was not required because it was a local
regulation between 100 and 1501.
Mr. Ball concurred and stated that they have always granted down to
1001 anyways. The Zone 11 is what would kick In the denitrification. But,
this was not in Zone 11. They have always granted it down anyways.
1
