i
5 M
requested a meeting with the BOF too. The meeting on October 3', 2002,
will address this issue and.the board's approach to handling the smoking
regulation.
Mr. Woolridge asked there were going to be any public meetings.
Mr. Santos replied that there would be no public forum meetings. The
issue has been discussed to death. The board has had more than enough
input from all interested parties.
Mr, Woolridge asked again if the restaurant grew was going to have a
meeting.
Mr. Ball replied that they weren't even given a chance. The vote has
basically been turned, which is the bottom live in the natter. '
Mr, woolridge was given a copy of the letter from town counsel.
B. Ille al Septic Installation
Mr. Santos updated Mr. Ball with the fact that the last meeting included
another situation of illegal installation of a septic in town. He wanted to
throw the suggestion out on the table that they place the burden on the
engineer to report to the Boli who the installer is on the job. They should
be working together. Somebody needs to take the ball on these
situations. The BOH doesn't have the time or the personnel to be able to
police emery single septic installation going on in town, should they put
the burden on the engineers and the owners?
Mr. Ball wanted to know why they couldn't issue a fine.
Mr. Harrington wasn't sure if Title V addressed this type of problem. Title
V solely asks the engineers to certify that the system was installed with
their design plan and Title V, He didn't feel that there was any burden of
proof within Title V that the engineer has to check that the installer is
licensed in the tonin. They would have to institute that by regulation
should they want to do that.
Ills. Warden suggested that they could send a list of the installers every
year.
Mr, Harrington stated that a lot of times the contractors aren't there
when the engineer goes to do their final inspection to twice their shots
and measurements as far as the location. The contractor is not there so
they don't actually know who put the system in. They are called after the
system is in to certify it.
