Mr. Ball stated that they would deal with that issue when it happened,
They were not done with this regulation either.
Ir. Santos agreed and stated that they hadn't gotten to the fines at this
point in time. Fie didn't want it to come out as a threat* However, he had a
serious problem with this pert of the regulation. It was helm allowed on
the beaches. The input he had gotten from a lot of people was, was the
board crazy.
Nis. Grady stated that the board was not crazy. she understood what h
was saying. she could not tolerate it. she thinks it looks horrible,
arson a taxpayer walking into this building through the backdoor
because you are just living in stroke all the time, That is where they got
She suggested that they compromise. she suggested ten feet away from
any doorway or ventilation intake fixture or window,, It would have to be
ten feet away.
Mr. Ball felt that that should come under a variance. Ms. Mason should
cone before the board and request a variance from the regulation, she
has found a designated smoking area for these people to go. It would be 4
" from the building. or if the Tinderbox were to cone in.
Ms. Grady stated that the board was saying that they were prohibiting
smoking in work places#
Mr. Ball responded that she was correct.
Nis. Grady continued by stating that they were not allowing smoking areas
per say.
Mr. Ball felt that an outside-designated area outside the building was
appropriate. The ten or twenty feet away from the doorway or building
would be appropriate. But, let therm cone in and let them decide, Maybe
they didn't want it ten feet away from the backdoor. That would all come
under the heeding of a "variance."What he was trying to say is that they
should go along with this whole regulation and leave the option for people
to cone in for a variance. Then the board could decide whether they went
to grant a variance for certain things or not. Did they want to grant a
variance for the beach, yes or no Did they want to grant a variance for
the town hall, Tinderbox, yes or no It should be based on individual
requests rather than a whole, He didn"t think it was fair to have a blanket
policy without any opportunity for further discussion, He felt that they
should leave it open, not locked in so that it was a turn around loots like
the town of Orleans that you could not go hack to it. They should leave it
open and let the individuals cone in. That is a fair way of doing it. Mr.
