Mr. Santos asked if there was any further discussion on this matter. <br /> Mr. Ball stated that Draft I is his preference. It is short and sweet with no <br /> evidence of discrimination. You are not singling anybody,, any group of <br /> people, non-profit or profit organizations or service. He was hoping that <br /> they would approve Draft I as they had originally voted on. <br /> Ms. Grady asked if Mr. Ball would elaborate a little bit as far as singling <br /> out individuals <br /> Mr. Ball responded that'Br ft I included everybody. Draft 11 doesn't. The <br /> grounds should include all of the grounds. Draft 11 you are limiting to <br /> recreation fields, playgrounds, owned, leased, operated and occupied by <br /> the town. What about beaches, transfer station and the town grounds? It's <br /> limited and Draft I isn't. He was under the impression that they had <br /> agreed on was that if this affected anyone say for example the beaches or <br /> Joyce Mason for here. They could write us a letter requesting a variance <br /> from our regulation. He didn't feel that it should not discriminate and be <br /> black and white. They vent after the business community. Now the rest of <br /> this community that it affected caused a lot of back feed from it. They <br /> should go after everyone. People do have a right to cone back in front of <br /> the board for a variance. <br /> Mr. Santos felt that with Draft I they were singling out town employees <br /> because this does include the DPW garage and any town property. The <br /> regulation was aimed at enclosed buildings and dwellings. This regulation <br /> is targeting the buildings, inside the buildings and not the open space. He <br /> felt that the regulation was including town owned property. For eXample if <br /> you pull into the stop & Shop parking lot and have a cigarette. But, if you <br /> pull into the Town Hall parking lot you have to throw it out into the street. <br /> Where does this town line start and stop? He felt that they were singling <br /> out certain individuals. He felt that Draft 11 was fair and open. It is <br /> covering all buildings not just private buildings and not just <br /> establishments. <br /> Mr. Ball felt that Draft 11 was singling out individuals. <br /> Ms. Grady felt that their premise was that environmental tobacco smoke <br /> can be harmful not to just those that are smoking but to other people that <br /> are in an enclosed area. That is what they granted to prevent. So if you <br /> are not in ars enclosed area you are going beyond their ability to try and <br /> protect people. That is why she felt that it was fine with just town <br /> buildings. She didn't feel that they needed to get into the grounds expect <br /> for the sports places, fields and playgrounds.
