IVIS. Daly added that they do have a zoning by-law on a commercial kennel. <br /> She didn't want to get into an argument with Mr, Bateman. But, certainly <br /> they have always had something on the boos as far as commercial <br /> kennels. They have clearly been a commercial business from day one. <br /> They have never said they were a commercial business. If they were, she <br /> always gives everybody the commercial schpiel. They would have to be in <br /> a commercially zoned area and wholly indoors. Dr. Morantz wanted an - <br /> deg kennel. He couldn't build it because of zoning. He was in residential. <br /> Yes, she was happy. <br /> M . Grady asked if she hadn't heard that there was something in place at <br /> one point that they chose to get rid of. <br /> Ms. Daly responded that back in 1987 they kind of did things according to <br /> the people you answer to at the time, which is a geed way to put it. She <br /> has dealt with so many different boards of selectmen and police chiefs. <br /> They all change and they all want something different, At the time <br /> kennels were something that they didn't know how to approach, They <br /> didn't have any definitions. She didn't feel that it was something that they <br /> should rush into. A lot of other towns have kennel laws in place and they <br /> are not necessarily good ones. She was hoping that the one that they <br /> propose... <br /> Mr. Harrington added that they had sat down and hammered one out using <br /> the other towns' regulations like they did with the smoking regulations <br /> and just cane up with some decent definitions. <br /> Mr. Ball noted that his point was why should It even go in front of the <br /> selectmen. If the board is the sole governing authority in this matter why <br /> should they be going to the selectmen? <br /> Mr, Harrington responded that they were not the sole authority. The chief <br /> of police was one authority and the board of health was the other. <br /> Ms. Grady asked why they just couldn't work together. IVIS. Grady asked <br /> Ms, Daly to re-iterate what was meant b "commercial". <br /> Ms. Daly responded that '&commercial" has been defined in this law and <br /> you would clearly know what it means. She did not have a cop] with her. <br /> It was a pretty strut laws <br /> Mr. Harrington added that as far as the approval process goes they would <br /> have to have the board's approval to do it. They have inserted the board of <br /> health just for that fact. Ms, Daly had this one handy little piece of <br /> legislation that occurred basically that the selectmen would stay out of it <br /> 1 <br />
