i
but changing the FAST system. There are different kinds of FAST systems,
When the system was originally designed it was supposed to be all office
space. During the course of the permitting some of the effluent qualities
were such that the FAST system people tela them that it was not
appropriate. They should have recommended a high strength FAST
system. So Mr. Beri h was willing to invest in that and that alone would
b $75,000.00 to retrofit the existing system to a high strength system,
The reason he was there this evening was to look for some positive
feedback and hopefully a document in writing from the board indicating
that they have openly and fully cooperated with the board and asked for
all permits and have Indeed all permits to install and legally operate the
Brickyard Marketplace, It was both his and his client's feeling that such a
letter may indeed ward off the litigation that the state is currently
pursuing. The state has not heard directly from the board at all on this
matter. He had spoken briefly with Mr. Harrington and he had suggested
that they come before the board and look for something supportive in
waiting in order to find a way out of this matter.
Mrs Ball asked Mr. Harrington what his take was on the matter.
Mr. Harrington replied that what he had said all along was that the two
key players, Elim iicuaid, who is deceased and Cristos Dmisioris, from
the DEP, who has dummied up. They were the two people who handled the
entire behind the scenes type of permitting where the board obviously
saw it at a public hearing. Then Mr. McQuaid and Mr, Dmisioris had their
conversations but no one knows what they were. Mr. Dmislorls is
obviously not saying anything. So, both sides are basically blaming Mr.
McQuaid claiming that it was Illus McQuaid who advised them against DEP
input or permitting. The DEP is stating that Mr, McQuaid let there go
ahead without DEP approvals Mrs Harrington felt that Mr. Dmi iorls might
have had some input as far as saying that they didn't need DEP approval.
The only way to find that out is to drag Mr. Dmisioris into court. However,
this is something that they would want to avoid because if it got to court,
Mr. Berish would turn and ultimately include the town in the line of
liability for that outcomes The town issued the permits to install.
Ultimately the variance shouldn't have been granted or at least at that
point there may have been some other consultation between Mr. McQuaid
and Mr. Dmisioris that said that it could have been approved that way. He
didn"t know. The two key players aren't of much help in this matters. As far
as the board writing a letter right now, Mr. Harrington didn't want the
town to be included in the liabilitym obviously, the right thing to do right
now is to get the system changed. So that if the DEP is so worried about
groundwater being effected why didn't they approve the revised the plans
to get this system fined with the high strength FAST put in since Mr.
Brish already said that he would do that. He doesn't Know why they
19
