OF <br /> ■ <br /> complaints dating back to May of 2002. They had spoken to the tenant at <br /> that time. The tenant did clean it up and took care of it. This past <br /> November the police gave therm a call and notified there that they had <br /> gone into the home on a domestic incdent,, They notified therm of the <br /> condition of the interior of the hone regarding several trash bags on the <br /> inside of the property, It was rather deplorable and decrepit conditions as <br /> they explained to there. They made several unsuccessful attempts to get <br /> into the home. Then this past January 10', 2004, the police on another <br /> domestic incident again notified theme. The police gave there pictures. <br /> They could certainly have the beard review them to understand the <br /> actions that the board took. The police notified them and showed therm <br /> the pictures that they had taken, They contacted the owner who was <br /> down in Florida. The owner faked the beard a letter-stating that he would <br /> take care of it. The board was certain that the combination of the medical <br /> condition of the person that was there and that he had previously returned <br /> to the home after two other incidents without marking any adjustments to <br /> his luring conditions. Mr. Harrington felt that that since this was now a <br /> third time the board needed to be involved in getting a hold on the <br /> enforcement basis to make sure that the property got cleaned up. They <br /> also, with the police department's recommendation, they obtained an <br /> administrative search warrant to search the house. He spoke with the <br /> owner. The owner stated that he needed a few days to clean things up. <br /> Mr. Harrington told him that the board's objective was to condemn the <br /> home and monitor it so that it would get cleaned up. The owner was dead <br /> set against that and refused them access. Mr, Harrington went and served <br /> the warrant until the last day of issuance. They went in and determined <br /> that some clean up had started at the property. It still had heat and water. <br /> The conditions were nowhere near as bad as the pictures. However, it <br /> was still at the point were they could issue a letter through the <br /> department stating that they dict go in to examine the borne. They could <br /> handle this rather than condemning it. They would have quite a fight on <br /> their hands if they condemned it even now at this point. The property is <br /> not occupied right now, Dight now there was no one ultimately in danger, <br /> Another reason why they needed the warrant was that they had received <br /> a call from the police that one of the occupants did try to return and <br /> occupy the house, This concerned him enough that the board needed <br /> further involvement. There was a large amount of liability that was now <br /> cleaned up. so if they went through their notion of sending an order letter <br /> along with thirty-days. They would be well on their way. His <br /> recommendation is that the board re-visits it at that point that would be <br /> fine. If they didn't clean it up they would begin to issue hint citations at <br /> that point anways. <br /> Mr. Santos asked what the extent of the clean up that had occurred at <br /> this point. <br /> 1 <br /> i <br />
