Mr. Harrington began by stating that the board had sent Ms. Donaldson a
letter because they had not received her payment or application for her
food establishment license. He felt that it was imperative that the beard
reviewed this. They did not feel that there was any imminent hazard or
danger or a reason for closure. He wanted the beard to determine why
they failed to provide the application and payment in a timely manner,
Mr. Ball asked who was going to speak on the establishment's behalf.
Mr. Donaldson stepped up to speak* He stated that they did not have a
good reason. They apologize for that. It was one of those things that
happened. They try to keep up with the standards that the board sets and
he understood why they were in place. They try really hard to keep up
with those standards and it was just one of those things that slipped by
them. He apologized for it and it would not happen main unless there was
a good solid reason for it.
Mr. Ball asked if they had done anything to correct it.
Mr. Donaldson came in here when they go the letter to see if it was too
late.
Ms. Warden had advised therm that if was too late and they would have to
appear before the board first.
Mr. Donaldson stated that that was why they were here and it was the
only step that they could have taken.
Mr. Harrington stated that their servsafe was up to date. It was still good
until 2007. They have been running a clean establishment that was up to
code other than the paper part of the situation, As far as the code
requirement, operating without a license, it goes basically from one
calendar year of January 111 to March 111, 2004, when they got notified.
That was basically 60 days. The hoard's option was to suspend the permit
for a period of time or fine for not $100.00 per first offense per day. That
was what was within their realm right now,, The board could obviously
issue a warming if they would like.
Mr. Ball asked Mr. Donaldson if this was the first time that they had
operated a business.
Mr. Donaldson responded that this was the first time they operated a
business of this sort, yes.
IVIS. Grady asked how many years they had been open.
2
