i <br /> I <br /> IIIb. McGrath stated that the DEP has required them to examine and report <br /> to them copies with every approval connected with Building A. The issue <br /> as far as the DEP is concerned that was a protection in Title V that <br /> basically says that any new construction under the 1970 code was <br /> deemed to conform with the 1995 code as long as it was operational, The <br /> DEP as far as they were concerned the capacity of the actual system that <br /> exists in the ground has been exceeded by the land uses that exist there. <br /> One of the issues is that this particular restaurant had been approved for <br /> fast food usage. They would either have 1seats at 20 GPD or 57 seats <br /> at 35 GPD in order to be within the original design capacity. The DEP <br /> asked hire to find a certificate of compliance. He found a bunch of <br /> information. He did bring copies of the information that he did find to file <br /> with the DEP. It was a rather complicated letter. But, it was a permitting <br /> history of this system. He was not in his office today so he was unable to <br /> stamp the plans. He would provide therm with a stamped plan tomorrow. <br /> These shover the additional septic tank. <br /> Mr. Harrington handed Mr. McGrath and Mr. Dalton a copy of some <br /> information. He stated that in preparing for tonight's meeting he found it <br /> In the permit file and not in the address file. He apologized for not finding <br /> it before. There was a request by carrbo's in May of 2007, when it was <br /> owned by Mr. carbonneau, to have twenty-five outdoor seats. There was <br /> an approval by the board on May 101", 2001, that seven seats had to be <br /> F removed from the interior of the restaurant and twenty-four seats may be <br /> placed outside for paper service only. The numbers were worked out that <br /> the system could handle the 61 seats inside but at 20 GPD per the outside <br /> and 24 seats. It was also worked out that if there was no service to be <br /> done outside those seats could be used inside. There were a total of 68 <br /> seats for inside use. When he figured that Mr. Rich rdi purchased the <br /> property he wrote'him a letter that 72 seats were applicable. He had <br /> figured the numbers differently from the way Mr. McQuaid had figured it. <br /> The board of health felt that 72 was the number of seats that he could <br /> have within the capacity of the system. He did not take into account the <br /> 24 outdoor seats. IIA . Warden stated that the seats would be taken out of <br /> the inside count to be placed outside. The actual approval for 2001 was <br /> for paper service only for outside. <br /> Mr. Ball asked if that was done. Did they take the seats from the inside <br /> and place them on the outside. <br /> Unknown person states that they did not do that. There were different <br /> seats out there. <br /> Mr, McGrath stated that the department's stance was that the available <br /> capacity and leaching systems that count, but ghat was the permitted <br /> 10 <br />
