■ M
96
Y
before they could finish anything. He was hoping to at least do those two
buildings. They would not let thein do that and he wanted to let the board
know that information. They have been speaking to each other. His
contention is that they bought a condo unit. Aust like he bought multiple
condo units. They own a percentage and he owned a percentage. It just
so happened that they were the largest user of the septic system on the
premises by far. He believed that when they purchased their unit before
he purchased his unit. They triggered the ► hole denitrification ordinance;
a local ordinance and they needed to comply. He wanted the hoard to
know that he was very willing to come in and pay his share of that. The
meeting that-he had with them he was hoping that they would go along
with it,, He said look there was 11 " amount of gallons used in Building A.
You use 11X" amount and the rest of the building used '1 " a mount. You pay
for your share of usage and I'll pay for my share of usage and this goes
away, We'll be all set. But, for some reason they will not agree to do that.
He felt that this was a fair thing for both sides. He did not want to spend
dollars from his pocket to provide therm with septic when they are the
largest user, He would pay for his share with the rest of those fourteen
units. He hadn't courted thein. Whatever the usage was for those fourteen
units was his responsibility as the owner of those units. But whatever he
owns and whatever he uses in his septic system was his share. The fact
that Mr. Richard! bought before he did a condo unit triggered this
denitrification system long before he showed up in Mashpee. He felt that
the burden was on his shoulders. He was willing to'pay his fair share to
get this done. Mr. McGrath had already done the engineering and he was
ready to move forward to put it to,bed. When he did come down to the
BOH they looked through the file. Maybe Mr. Harrington found-sone new
information. But, had never seen where they were allowed 70 some odd
seats in this restaurant. He never saw that approval. He did see some
letters that allowed them to go from 58 seats to 100 based on paper
plates and plastic. But, that was all that he had seen. But, maybe this was
something that he and Mr. McGrath had not had a chance to review. That
was basically his position. He wanted this tiring dome.
Mr, Ball asked if both parties had been negotiating back and forth* Had
they all come to an agreement?
Ir. Hajjar replied that he had been speaking to Mr, F ichardi for months
and months. They just pushed this thing off. They just had their first
meeting yesterday although he had been pushing to get this thing done.
He wanted it finished, They had a meeting and he left Mr, Dalton a
message this afternoon. He said if there was an agreement, He did make
a proposal that they each pay their pro-rated share and it would be done.
He asked that they give hila a call and let him know so that when they go
in front of the board they aught be able to tell therm that they had a
1
