They have to get special permits because they <br /> were in a I -year flood plain. For right now they were in agreement to be in the <br /> program. But, he would Up to see'if there was a way that they could petition or <br /> appeal this for review of the definition of beach and whether it applies to them. <br /> Mr. Harrington recommended that they check with the state. It was the state"s <br /> regulation to not be considered a beach. As far as what other conditions that they <br /> have explained tonight regarding the fact that he and Ms, warden felt that it met the <br /> criteria for a beach. He needed to clarify with the state as to whether or not it was <br /> maintained as a beach. They were saying that it was being maintained as a beach for <br /> swimming. He Just needed to get from the state how they clarify or what other <br /> conditions need to be made f r it not to be a swimming or bathing beach. <br /> Mr. Umina re-iterated that it was very mudding there. It was probably good for shell <br /> fishing. <br /> 1r. Darrington did not disagree with him. But, the way that they saw it and set it u <br /> the first time was that it met the criteria as lacing a semi-public being owned by an <br /> association. It was sandy with proper access. People were going in and out of the <br /> water. There people-in the water when he was there. It met all of the criteria at that <br /> time. They would have to find some other way for restriction for them to not be part <br /> of the program. They would have to find out from the state to do that. <br /> IIs. Grady suggested that they could work on it. <br /> Mr. Harrington responded that of course they had tons of time t do that. <br /> 1s. Grady stated that it needed to continue to be tested,, which they were doing now. <br /> Mr. Santos asked if the bottom line was that they did not want to pay the $3,000.00. <br /> Mr. Umina stated that that was a starter. They did want to do what was right, too. <br /> Mr. Santos stated that do to their not receiving the certified letter and the current <br /> discussion. His recommendation would be to rescind the $3,000.00 and impose a <br /> $100.00. They did'admit to-notification. They agents did spend their time going out <br /> there and posting a sign.
