Sign Warrant. Board members signed the warrant. <br /> 2. Mike Wilson — 12 Rock Island Road <br /> Michael Wilson introduced himself to the Board, stating that he had purchased a home <br /> last July at 12 Rock Island Road in New Seabury. On July 22, 2009, the Board of Health <br /> approved an enforceable variance agreement for the Wilsons} with the condition that <br /> Title V design plans should be submitted and approved by the BOH, and the existing <br /> dwelling should be razed by Dec. 1, 2009. The closing date for the property was <br /> scheduled for 8/05109, but the actual closing did not take e place until 10130/09 because <br /> the sellers were unable to cure a title defect during the 30-day extension period. The <br /> result of the problem was an --day delay in the closing-date. Mr. Wilson n was now <br /> requesting an extension of the enforceable agreement equal to the delay in their closing <br /> date, i.e., until 1^ebru ary 24, 2010. Elizabeth McN ichols, attorney for the Wilsons, stated <br /> in a letter to the Board of Health dated 11/02109 that the Wilsons will immediately sign <br /> the appropriate enforceable agreement reflecting the new conditions. <br /> Lucy Burton commented that the Board had never before granted an exception to an <br /> enforceable agreement, stating that this would be a very rave occurrence} due to the <br /> unusual circumstances involved. Lucy Burton stated further that it must be understood <br /> that there would be no additional extensions to the amended enforceable agreement. <br /> Lucy Burton made a motion that the Board approve the 85-day extension for approval of <br /> Title V septic design pians for 12 Rock Island Road and for the razing of the existing <br /> dwelling, with 7 days to revise the original enforceable agreement approved by the BOH <br /> on 7122/09. Kalliope Egloff seconded the motion. All approved. <br /> . Approve Public session Minutes of 10/141090 <br /> Lucy Burton made a motion to approve as amended the minutes for the Board of Health <br /> meeting held on 10/14/09. Kalliope Egloff seconded the motion. All approved. <br /> 4. Title v violations: 14 seconsett Point Road <br /> Glen Harrington stated that on Sept. 28, 2009 a certified order letter from the BOH was <br /> forwarded to MrA Mrs. Federico, owners of the property at14 Sec n eft Point Road, <br /> stating that they should retain the services of a Licensed Professional Engineer or <br /> Registered sanitarian to prepare a design plan for the septic system repair within 1 <br /> days from receipt of the letter and to pump the septic tank within 24 hogs with <br /> notification to the BOH at that time.
