Box 826 <br /> Orleans, MA 02653 <br /> RE: NOTICE OF NON-COMPLIANCE —REFUSE REGULATION <br /> Dear Mr. Delude: <br /> On June 11, 2010, I observed a Nauset Disposal front-loader servicing solid waste <br /> containers at Jiffy Lube, 60 Falmouth Road, Mashpee, MA. Therefore, Nauset Disposal <br /> is hauling refuse in the town of Mashpee without a Board of Health issued permit. This <br /> is a violation of Massachusetts General Law Chapter i l I section 31A. <br /> Nauset Disposal is also disposing of Mashpee commercial refuse at a waste facility not <br /> approved by the Board of Health. This is in direct violation of the Mashpee Board of <br /> Health "Refuse Regulation". The regulation states, "All haulers licensed by the Board of <br /> Health in the Town of Mashpee must transport their refuse loads to the Upper Cape <br /> Regional Transfer Station, which is a Board of Health approved site or other facility <br /> approved by the Board of Health and, in the case of the Upper Cape Regional Transfer <br /> Station, must follow the route specified in the Upper Cape Regional Transfer Station <br /> rules and regulations. No refuse loads may be disposed of at any site other than one <br /> approved by the Board of Health." (I have enclosed a copy of the entire regulation for <br /> your convenience.) <br /> You are hereby ordered to appear before the Board of Health on July 14, 2010 at <br /> 7:15 p.m. in Conference Room #3, Mashpee Town Hall, 16 Great Neck Road North, <br /> Mashpee, NIA to "show cause" as to why you have failed to comply with the Board of . <br /> Health "Refuse Regulation" and M.G.L. 11 l s. 31A. <br /> Failure to comply shall subject you fines and/or court action.
