Balker stated thatthe B 0 H voted some tirne back to recognize the health har and regarding <br /> the problem of blue green algae in-Santult Pond. .An ad hoc group, Friends of the Santult Pond, <br /> put together ar proposed by-laver to control the utilization of lawn fertilizers containing phosphorous, <br /> brought it to the Environmental Oversight Commiftee, and that Committee nova is looking for the <br /> presentation of the by-law at the Spring Tavern fleeting. <br /> Mr. Baker stated that he carne tonight to ask that the Board of Health please vote to support the <br /> proposed phosphorus by-laver so that when it is presented at Town Meeting next spring, the <br /> electorate can be informed that not only the Environmental Oversight C&Mmittee recommends <br /> that it be passed, but also the Board of Health has r view d the by-laver and feels that it is the <br /> provident thing to d . <br /> Lucy Burton stated that the intent of thep roposed by-lave is appropriate, but the BOH has three <br /> major concerns with it; <br /> 1} surrounding towns are contributing to the phosphorus in l ashpee's water; the by-lar would <br /> have to be passed regionally in order to clean up the estuaries that the bordering tons share <br /> } <br /> in order to be effective, the ir-lawould need to apply to all products containing phosphorus, <br /> i.e., detergents # and not just lawn fertilizer <br /> 3) enforcement of the regulation would be a serious challenge for the BOF _ <br /> Mr. Baker agreed that a fl ashpee by-law by itself is not enough to solve the problem, but than <br /> someone ne needs to ieard the way and his feeling was that Mar hpee should take the lead. <br /> lei a l ff stated that the BOH members were uncomfortable with the enforcement issue f <br /> a p g <br /> the proposed by-law, and questioned why the anus for enforcement was placed on the shoulders <br /> f the 130H. l lliope stated further that the BOH is always concerned about the enforcement of <br /> regulations, and if it Is determined that ar regulation is not enforceable, then it Is no longer under <br /> consideration. The BOH staff is already stretched thea, and to add the burden of enforcement of r <br /> the proposed phosphorus by-law was unreasonable. <br /> t <br />
