t <br /> t <br /> TOWN OF M <br /> BOARD OHEALTH — PUBLIC SESSION <br /> Minutes of the Meeting f1I Wednesday, February 16, 2011 <br /> Town Hall — conference Room 3 <br /> Board Members Present: Member Absent: : <br /> Also Present. <br /> Kalliope Egloff, Chairman Lucy Burton, Co-Chairman GlEin Harrington, Health Agent <br /> Barton Kaplan, Clerk <br /> Chairman Kalliope Egloff called the meeting to order at 7:00 frill. <br /> APPOINTMENTS <br /> :1 cape& Islands Engineering— 10 P pp nesset Island Road <br /> John Slavinsy of Cape& Islands Engineering introduced himself to the Board. <br /> .len Harrington gave background on the appointment, stating that an enforceable <br /> agreement was placed on the property due to a vadance from the BOH cesspool <br /> Reg ulation. The enforceable agreement was signed on 10/1 1g with a date of-2101/11 to <br /> complete the septic system with the certificate of Compliance issued. One of the Board's <br /> requirements to issue a septic permit wasto receive a legal opinion to install the SAS in a <br /> right-of-way. The legal opinion was received by the BOH office on 1119111. The septic <br /> permit was obtained on1/20/11. John Slavinsl y was requesting a 3131111 enforceable <br /> agreement extension date. <br /> John Slavinsly outlined the reasons for the need for an extension of time: <br /> 1The new owner/all contractors were not allowed on the property after the sale for <br /> a period of one month <br /> 2 Once Ion's Excavating was allowed onto the property, their Cape & Islands plan was <br /> drawn not knowing where the utilities, water service line-or pipe for the septic <br /> system were corning out of the house. <br /> 3) Once contractors were allowed on site with the owner they determined the septic <br /> pipe was in the wrong area. The plan was revised to show the new water service <br /> and septic pipe. An application was filed with the Conservation commission to obtain <br /> approvals to.rncve the silt fence and service lines. <br /> 4) Inclement weather conditions and amount of fast in the ground delayed work <br /> 5) Owner was out of the country due to a family hardship <br /> John Slavinsi y stated further that currently there is no one living In the house as the water <br /> service has been shut down for the winter. Mr. Slavinsi y is requesting an-e tension to <br /> 3131 11 to allow tim for F on's E cavating and other contractors to p rform their services. <br /> Burton Kaplan made a motion that the date for completion of installation of the new septic <br /> system at 10 Popponesset Island Road be amended to February 28, 2011, and that in the <br /> absence of that happening, a $500 fine be assessed. Calliope Egloff seconded the motion. <br /> The motion was unanimously approved. <br />
