t <br /> MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> DECEMBER 13,2017 <br /> 65 Treasure Lane: Owners,David W. and Lauren A. Richards request a Written Finding <br /> under §174-17 of the Zoning Bylaws to allow for construction of a second floor addition <br /> to a pre-existing non-conforming structure on property located in an R-3 Zoning District, <br /> (Map 96 Parcel 46), M'ashpee, MA. <br /> Attorney Kevin Kirrane represented the homeowners for the'specific Written Finding.Also <br /> present was the homeowner, David Richards. Mr. Kirrane provided the Board with a <br /> narrative, site plan, and photographs of the area. The project consists of a relatively small <br /> second story addition to the existing relatively small structure,and is proposing to eliminate <br /> the two decks that are outlined on the plan. A second story will be added and there will <br /> also be a small front porch added to that particular structure. The structure itself is non- <br /> conforming because it only sits 13.3 ft. from the lot line that it shares with lot 146 and it <br /> currently is only 29.6 ft. from Treasure Lane. The lot is a corner type lot that is situated on <br /> Treasure Lane and Captains Row. The proposed front setback will conform on Captains <br /> Row, and will not increase that non-conformity. There is a non-conformity increasing <br /> slightly from 29.6 ft. to 32 ft, relative to that front porch. The second floor addition <br /> conforms to other structures in the neighborhood. The structure is set back far enough so it <br /> will not be creating any sight issues with either pedestrian or vehicular travel. The lot <br /> coverage is not increasing and is dropping from 12.8% to 11.1%. In his closing remarks, <br /> Mr. Kirrane said that this project is not more detrimental than what currently exists, and <br /> the setbacks that are being proposed are more than adequate to provide the appropriate <br /> safeguards, and there is plenty of parking as required. <br /> Mr. Goldstein commented that given the lot coverage is getting better, it's not touching the <br /> ground, and the porch getting a little closer is not an issue. He does not have any issues <br /> with the project. <br /> Mr. Blaisdell read the Conservation, Board of Health comments into the record. Mr. <br /> Goldstein read the Inspection Department comments into the record. <br /> There were no more comments from the Board or audience. <br /> Mr. Goldstein made a motion to approve the house project for a second story addition with <br /> the following conditions; Site Plan David and Lauren Richard, #65 Treasure Lane, <br /> Mashpee, MA.
