Peros requesting a <br /> Variance of the side yard setback under §174-31 of the Zoning Bylaws to allow for <br /> construction of a 6' x 13' addition to an existing single-family dwelling on property located <br /> in an R-3 Zoning District, and Popponesset Overlay District, at 16 Bluff Avenue, (Map <br /> 112 Parcel 93),Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on October 13, 2017 and October 20, 2017 a <br /> copy of which is attached hereto and made a part hereof. <br /> Public Hearings were held on Wednesday,November 8,2017 at the Mashpee Town <br /> Hall,at which time this Petition was heard,but the applicant withdrew his Variance request <br /> because the members of the Board thought the variance request was extensive and the <br /> project would be encroaching on the neighbor. <br /> After the hearing in November,the applicant met with the Building Commissioner, <br /> Michael Mendoza to discuss possible options on how to comply with the 15 ft. side yard <br /> setback. Mr. Mendoza reviewed the drawings, and suggested the applicant discuss these <br /> options with the Board because there were several mitigating circumstances that involved <br /> accommodating a handicapped person. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, December 13, 2017 at which time the following members of the Board of <br /> Appeals were present and acting throughout; Acting Chairman, William Blaisdell, Board <br /> Members,Dom DeBarros, Scott Goldstein,and Associate Members,Sharon Sangeleer and <br /> Norman J. Gould. Also present was Building Commissioner,Michael Mendoza. <br /> Acting Chairman, Bill Blaisdell addressed the Board, and after reviewing the <br /> application, he suggested the Board reopen this case because he believed there was a <br /> hardship involved, and therefore a Variance may be appropriate considering the special <br /> circumstances. Mr.Blaisdell asked the Building Commissioner to present his findings,and <br /> make some recommendations. <br /> 1 <br />
