(Owners of <br /> Record: Stuart and Christine Nixdorff). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise,a newspaper of <br /> general circulation in the Town of Mashpee, on October 13,2017 and October 20, 2017 a <br /> copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this .Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, November 8, 2017 at which time the following members of the Board of <br /> Appeals were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, <br /> Board Members,Ron Bonvie,Dom DeBarros, Associate Member, Sharon Sangeleer. <br /> Mr. Frank Westgate represented the homeowner's application for a Variance <br /> request for the reconstruction of their driveway that is within the 50 ft. buffer setback from <br /> the wetlands. He said the driveway slopes down from the road at a 28 foot length and is 12 <br /> to 14 feet wide, and slopes under the basement which is the existing garage. There are two <br /> concrete retaining walls and the fill will not go above those walls. There will be no need <br /> for a curb cut,and it will have no drainage issues. There will be a slight pitch toward Little <br /> Neck Lane with gravel fill and a pea stone finish that will control the drainage. <br /> The Board read the Conservation, Board of Health and Inspection Department <br /> comments into the record. <br /> There were no abutters present. <br /> 1 <br />
