Avant and Bk: #28492 <br /> Yvonne A. Avant Pg.: #75 <br /> 153 Main St., (Map 37 Parcel 54) <br /> Mashpee, MA 02649 <br /> A Petition was filed on November 3, 2017 by Owner, Elliot L. Avant requesting a <br /> Special Permit under §174-45.4 of the Zoning Bylaws to allow for an accessory apartment <br /> on property located in an R-5 Zoning District, (Map 37 Parcel 54), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on November 10, 2017 and November 17, <br /> 2017 a copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> The Board opened the case at the December 13, 2017 hearings and continued the <br /> hearing until January 10, 2018 because there was no representation. The Board opened the <br /> case on January 10, 2018 at which time Yvonne Avant, the homeowner, was present and <br /> provided the Board with photos and a hand-drawn plan of the existing accessory apartment. <br /> The Board reviewed the application and discovered some items they wanted corrected,and <br /> asked the Building Commissioner.if he could do an inspection. The Board continued the <br /> hearing and gave the applicant time to make some adjustments prior to the next hearing. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 14, 2018 at which time the following members of the Board of <br /> Appeals were present; Acting Chairman, William Blaisdell,Board Members, Ron Bonvie, <br /> Dom DeBarros, and Scott Goldstein, and Associate Member, Sharon Sangeleer. Also <br /> present was Building Commissioner, Michael Mendoza. <br /> Mr. Mendoza presented his inspection findings to the Board as they requested at <br /> the last hearing on January 10, 2018. He supplied photos for the Board that depicted the <br /> areas of the dwelling and showing the existing accessory apartment. Mr, Mendoza had <br /> photos showing the construction of the stairs, and the photo that represents the second <br /> means of egress. <br /> 1 <br />
