Richards, TTI and Bk.: #29185 <br /> Lauren Anne-Balzarini Richards Page: # 188 <br /> 65 Treasure Lane <br /> (Map 96 Parcel 46) <br /> Mashpee, MA 02649 <br /> A Petition was filed on November 1, 2017 by Owners, David W. and Lauren A. <br /> Richards requesting a Written Finding under §174-17 of the Zoning Bylaws to allow for <br /> construction of a second floor addition to a pre-existing non-conforming structure on <br /> property located in an R-3 Zoning District, at 65 Treasure Lane, (Map 96 Parcel 46), <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on November 10, 2017 and November 17, <br /> 2017 a copy of which is attached hereto and made a part hereof. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, December 13, 2017 at which time the following members of the Board of <br /> Appeals were present; Acting Chairman, William Blaisdell, Board Members, Dom <br /> DeBarros, Scott Goldstein, and Associate Members, Brad Pittsley and Norman J. Gould. <br /> Also present was Building Commissioner, Michael Mendoza. <br /> Attorney Kevin Kirrane represented the homeowners for the specific Written <br /> Finding. Also present was the homeowner, David Richards. Mr. Kirrane provided the <br /> Board with a narrative, site plan, and photographs of the area. The project consists of a <br /> relatively small second story addition to the existing relatively small structure, and is <br /> proposing to eliminate the two decks that are outlined on the plan. A second story will be <br /> added and there will also be a small front porch added to that particular structure. <br /> The structure itself is non-conforming because it only sits 133 ft. from the lot line <br /> that it shares with lot 146 and it currently is only 29.6 ft. from Treasure Lane. The lot is a <br /> corner type lot that is situated on Treasure Lane and Captains Row. The proposed front <br /> setback will conform on Captains Row, and will not increase that non-conformity. <br /> There is a non-conformity increasing slightly from 29.6 ft. to 32 ft. relative to that <br /> front porch. The second floor addition conforms to other structures in the neighborhood. <br /> The structure is set back far enough so it will not be creating any sight issues with either <br /> pedestrian or vehicular travel. <br /> 1 <br />
