PARTIES <br /> 3. Plaintiff Katherine McBrien is an individual and owns a property located at 37 <br /> Center Street, Mashpee, Massachusetts 02649 <br /> 4. The Defendants Jonathan Furbush, William Blaisdell, Ronald Bonvie, Scott <br /> Goldstein, Domingo DeBarros, Bradford Pittsley and Norman J. Gould are individuals <br /> and are the members of the ZBA with an address of 16 Great Neck Road South, <br /> Mashpee, Massachusetts 02649. <br /> FACTS <br /> 5. The ZBA issued a comprehensive permit on May 5, 2004, for the condmonium <br /> development in which the Plaintiffs property is located. See Land Court Document <br /> Number 986676, as amended by Document No. 1020569. <br /> 6. The Plaintiff was deeded a "moderate income" unit within that development in <br /> December, 2005. Land Court Document No. 1021107. <br /> 7. The deed included a restriction that limited the resale cost and required the <br /> Housing Assistance Corporation ("HAC") to attempt to find a "moderate income" buyer <br /> for the unit and allowed the Town of Mashpee to purchase the unit. <br /> 8. The Plaintiff desires to sell the unit for the price defined by the restriction and <br /> provided notice to HAC and the Town so that HAC could comply with its obligations <br /> and/or the Town of Mashpee could purchase the unit. <br /> 2 <br />
