Q`6499 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A VARIANCE <br /> V-2017-29 <br /> LaCava Family 11, LLC Bk. #: 12097 <br /> 29 Payamps Road Pg. #: 163 <br /> (Map 59 Parcel 11) <br /> Mashpee, MA 02649 <br /> A Petition was filed on May 2, 2017 by the LaCava Family 11, LLC requesting a <br /> Variance from the lot size requirements under §174-31 of the Zoning Bylaws to allow for <br /> a single-family residential use on property located in an R-5 Zoning District,Map 59 Parcel <br /> 11, Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpec Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on May 12, 2017 and May 19, 2017 a copy of <br /> which is attached hereto. and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 14, 2017 at which time the following members of the Board of Appeals <br /> were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board <br /> Members,Dom DeBarros,and Scott Goldstein,and Associate Member,Brad Pittsley. Also <br /> present was Building Commissioner,Michael Mendoza. <br /> Attorney Kevin Kirrane represented the applicant for the petition request. Mr. <br /> Kirrane gave a brief history of the seven lots along this road that were given variance relief. <br /> These lots were developed by the LaCava Family,and due to the down turn of the economy <br /> after 1985 they were unable to market and sell the lots. Mr. Kirrane presented the variance <br /> relief to the Board because the zoning had changed, and since that time they had been <br /> approved the protection afforded under the sub-division control law had expired.The Town <br /> modified the zoning to require 80,000 sq. ft. lots in this particular R-5 Zoning District. At <br /> that time, the Board did grant the variance relief or to sell those seven lots to be built on <br /> for single-family residential purposes. Four of those seven lots have been sold and were <br /> built on. <br /> 1 <br />
