Flood requesting a side yard Variance under §174-31 of the Zoning Bylaws to replace <br /> an existing deck with an enclosed four season room on property located in an R3 Zoning <br /> District, at 32 Gia Lane, Map 104 Parcel 41,Mashpee;MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on May 12, 2017 and May 19,2017 a copy of <br /> which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 14, 2017 at which time the following members of the Board of Appeals <br /> were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board <br /> Members,Dorn DeBarros,and Scott Goldstein,and Associate Member,Brad Pittsley. Also <br /> present was Building Commissioner,Michael Mendoza. <br /> Michael Flood represented himself for the request. He said he has a 12' x 12' deck <br /> in the rear of his house and wants to move it over one foot, and turn it into a four season <br /> room. He said he is 9 ft. 1 inch off the property line and is looking to move it 8 ft. off the <br /> property line. He said his surveyor told him that in 1972 when the sub-division was built, <br /> the cement pour for the house foundation was in the wrong location and at that time the <br /> property line was extended 11 ft. into the neighbor's yard on the side.He proposes to move <br /> the deck for aesthetic reasons and to add the stairs. <br /> Chairman Furbush read the Conservation, Board of Health, and Inspection <br /> Department comments into the record. <br /> The Board had a discussion regarding the proposed addition and told the applicant <br /> it has to have a 6 ft. opening as per the Board of Health comments. <br /> 1 <br />
