Town of Mashpee <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> FINDING-2017-24 <br /> Neal Kanter Bk#: 2285 <br /> 5 Kanter Lane Page#: 109 <br /> (Map 119 Parcel I A-0) <br /> Mashpee,MA 02649 <br /> A Petition was filed on April 19,2017 by Owner,Neal Kanter requesting a Written <br /> Finding under§174-17 of the Zoning Bylaws to raze and replace a single-family dwelling, <br /> deck and garage on property located in an R3 Zoning District, 5 Kanter Lane, (Map 119 <br /> Parcel 1 A-0),Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise,a newspaper of <br /> general circulation in the Town of Mashpee,on April 28,2017 and May 5,2017 a copy of <br /> which is attached hereto and made a part hereof <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, May 24, 2017 at which time the following members of the Board of Appeals <br /> were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board <br /> Members,Ron Bonvie,Dom DeBarros,and Scott Goldstein,and Associate Members,Brad <br /> Pittsley and Norman J. Gould. Also present was Building Commissioner, Michael <br /> Mendoza. <br /> Mr.Neal Kanter represented himself for the proposed raze and replace project. He <br /> said his family has owned the property for over 50 years, and is currently just using the <br /> property as a summer cottage. It was built roughly in the 1930's,and was remodeled many <br /> times over the years and is currently uninhabitable due to the septic system failure. The <br /> current house was there prior to the lot being subdivide and the road being constructed.He <br /> is proposing to build a new house similar to the current house with a slight increase in the <br /> foot print being 2 ft.toward Kanter Lane,and 1.5 ft. setback increase on the West side,the <br /> foundation setback will increase from 7 ft.to 10 ft. <br /> Mr. Bonvic read the Inspection Department comments into the record. Chairman <br /> Furbush read the Board of Health and Conservation comments into the record. <br /> 1 <br />
