Decter Doc. 4: 1299814
44 Popponesset Island Road Ctf.: #210232
(Map 106 Parcel 23)
Mashpee,MA 02649
A Petition was filed on by Owner, Adam J. Decter requesting a Special Permit
under §174-25 (I) (9) of the Zoning Bylaws to construct and maintain a dock complex
which extends across a total of more than 70' feet of coastal wetland resource areas on
property located in an R-3 Zoning District, 44 Popponesset Island Road, Map 106 Parcel
23,Mashpee,MA.
Notice was duly given to abutters in accordance with Massachusetts General Laws
Chapter 40A.Notice was given by publication in The Mashpee Enterprise,a newspaper of
general circulation in the Town of Mashpee,on April 28,2017 and May 5,2017 a copy of
which is attached hereto and made a part hereof.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee
Zoning By-laws.
Public Hearings were held on the Petition at the Mashpee Town Hall on
Wednesday, May 24, 2017 at which time the following members of the Board of Appeals
were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board
Members,Ron Bonvie,Dom DeBarros,and Scott Goldstein,and Associate Members,Brad
Pittsley and Norman J. Gould. Also present was Building Commissioner, Michael
Mendoza.
Board Member Scott Goldstein recused himself from this hearing. Sitting in on this
hearing is Associate Norman J. Gould.
Attorney Kevin Kirrane represented the homeowner for the proposed dock
complex. He said that most accessory docks are allowed as of right, however this dock
extends more than 70 ft. over coastal resource areas so there is a requirement that the
applicant come before the Board for the purposes of obtaining a special permit to extend
more than the 70 ft. over coastal resource areas.
The plan depicted that the total complex will extend over the coastal bank to about
215 ft.from the top of the coastal bank and making sure there is sufficient depth for docking
a boat adjacent to the proposed float.
1
i
