Decter requesting a Special Permit <br /> under §174-25 (I) (9) of the Zoning Bylaws to construct and maintain a dock complex <br /> which extends across a total of more than 70' feet of coastal wetland resource areas on <br /> property located in an R-3 Zoning District, 44 Popponesset Island Road, Map 106 Parcel <br /> 23,Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise,a newspaper of <br /> general circulation in the Town of Mashpee,on April 28,2017 and May 5,2017 a copy of <br /> which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, May 24, 2017 at which time the following members of the Board of Appeals <br /> were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board <br /> Members,Ron Bonvie,Dom DeBarros,and Scott Goldstein,and Associate Members,Brad <br /> Pittsley and Norman J. Gould. Also present was Building Commissioner, Michael <br /> Mendoza. <br /> Board Member Scott Goldstein recused himself from this hearing. Sitting in on this <br /> hearing is Associate Norman J. Gould. <br /> Attorney Kevin Kirrane represented the homeowner for the proposed dock <br /> complex. He said that most accessory docks are allowed as of right, however this dock <br /> extends more than 70 ft. over coastal resource areas so there is a requirement that the <br /> applicant come before the Board for the purposes of obtaining a special permit to extend <br /> more than the 70 ft. over coastal resource areas. <br /> The plan depicted that the total complex will extend over the coastal bank to about <br /> 215 ft.from the top of the coastal bank and making sure there is sufficient depth for docking <br /> a boat adjacent to the proposed float. <br /> 1 <br /> i <br />
