Gillis, Jr., requesting a <br /> Variance under §174•-31 of the Zoning Bylaws for setbacks and lot coverage requirements, <br /> and a Variance under §174-33 for setbacks from water and wetlands, to raze and replace a <br /> single-family dwelling on property located in an R-5 Zoning District, 18 Shorewood Drive, <br /> Map 58 Parcel 34, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on January 6, 2017 and January 13, 2017 a <br /> copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 22, 2017 at which time the following members of the Board of <br /> Appeals were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, <br /> Board Members, Ron Bonvie, Dom DeBarros, and Scott Goldstein, and Associate <br /> Members, Brad Pittsley and Norman J. Gould. Also present was Building Commissioner, <br /> Michael Mendoza. <br /> Mr. John Gillis represented himself for his raze and replace project. He provided <br /> the Board with revised plans based on the Board's recommendations from the previous <br /> hearing. The revised plot plan depicts a 10,500 sq. ft. lot. The new house will have a 46 ft. <br /> front setback, the rear setback will be 44 ft., the right side setback will be 15 ft., and the <br /> left side setback will be 13 ft. It will be a two story house with the minimum lot coverage <br /> at 17.2%. <br /> Mr. Gillis said that at the previous meeting, he was told by Chairman Furbush that <br /> the 13 ft. on the left side setback was pre-existing,non-conforming. Mr. Gillis believes that <br /> he has met all the criteria for the setbacks.He received comments from the Board of Health, <br /> DPW, and Conservation who expressed their requirements. He also provided two abutter <br /> letters that were in favor of his project. <br /> 1 <br />
