Spencer requesting a Written <br /> Finding under §174-17 of the Zoning Bylaws to raise existing non-conforming structure <br /> and install a new foundation beneath said structure, and to construct modest additions and <br /> deck to the existing non-conforming structure on property located in an R-3 Zoning <br /> District, 29 Riverside Road, Map 119 Parcel 81-0, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on January 13, 2017 and January 20, 2017 a <br /> copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 22, 2017 at which time the following members of the Board of <br /> Appeals were present and sitting in; Chairman,Jonathan Furbush,Vice Chairman,William <br /> Blaisdell, Board Members, Dom DeBarros, and Scott Goldstein, and Associate Members, <br /> Brad Pittsley. <br /> Attorney Kevin Kirrane represented the applicant for this project. Also present was <br /> the homeowner, Russ Spencer, Tom Bunker of BSS Design, and Beatrice Bunker, <br /> Architect. The project consists of raising the "Cottage#2" and moving it 3 ft. further from <br /> the property line with two modest additions attached to the dwelling, as well as a deck. <br /> This property is situated on Seconsett Island that is a unique community within the Town <br /> as there is a series of small cottage colonies throughout the neighborhood. As depicted on <br /> the plan, there are four residential structures situated on this lot. These structures have <br /> existed since the early 1950's and have existed prior to the time that the Town adopted the <br /> zoning bylaws. Therefore not only the use, but the structures are pre-existing, non- <br /> conforming uses and structures. <br /> 1 <br />
