Jalbert Ct£ #: 211654 <br /> 43 Monahansett Road Lot#: 1792 and 1794 <br /> (Map 123 Parcel 103) Plan#: 11408-213 <br /> Mashpee, MA 02649 11408-214 <br /> A Petition was filed on February 3, 2017 by Owner, Cynthia A. Jalbert requesting <br /> a minor modification to remove all reference to the trust from an approved Variance <br /> Decision (Attached) located at 43 Monahansett Road, (Map 123 Parcel 103), Mashpee, <br /> MA. <br /> The recently approved Variance application was for construction of a deck from <br /> the 50 ft,buffer under§174-33 regarding setbacks from water and wetlands. When Cynthia <br /> originally applied for this Variance petition, the house was in a trust and the deed stated <br /> "Paul A. Jalbert and Cynthia A. Jalbert, Trustees", and during her appeal period the deed <br /> was revised removing all reference of the "trust"as advised by her attorney. <br /> The Board reviewed the deed and agreed that this is considered a minor <br /> modification. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. No public notification to abutters was required for this minor <br /> modification. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 22, 2017 at which time the following members.of the Board of <br /> Appeals were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, <br /> Board Members, Ron Bonvie, Dom DeBarros, and Scott Goldstein, and Associate <br /> Members, Brad Pittsley and Norman J. Gould. Also present was Building Commissioner, <br /> Michael Mendoza. <br /> The Board granted a minor modification to Paul A. Jalbert and Cynthia A. Jalbert, <br /> Trustees of the Jalbert Realty Trust, at the Public Hearings dated Wednesday,February 22, <br /> 2017 for an approved Variance at 43 Monahansett Road, (Map 123 Parcel 103), Mashpee, <br /> MA, changing the name on the recording for the applicant now reading Paul A. Jalbert and <br /> Cynthia A. Jalbert, individuals, and not as trustees,referencing the Variance (V-2016-04). <br /> All other aspects of the Variance remain full force in affect, and no other modifications <br /> requested for issuance. The Board considered this request as a minor modification without <br /> the need to go through a formal hearings process. <br /> 1 <br />
