Kazarian Plan#: 35464-B (Sheet 5) <br /> 10 Waterline Drive North <br /> (Map 120 Parcel 174) <br /> Mashpee, MA 02649 <br /> A Petition was filed March 9, 2017 by Owners, Edward and Sally Kazarian <br /> requesting a Written Finding under §174-17 (Nonconforming buildings and uses) and <br /> §174-33 (Setback from water and wetlands)to allow for an addition on property located in <br /> an R-3 Zoning District, 10 Waterline Drive North, Map 120 Parcel 174, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general.circulation in the Town of Mashpee, on March 17, 2017 and March 24, 2017 a <br /> copy of which is attached hereto and made a part hereof <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 12, 2017 at which time the following members of the Board of Appeals <br /> were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board <br /> Members, Ron Bonvie, and Scott Goldstein, and Associate Members, Brad Pittsley and <br /> Norman J. Gould. Also present was Building Commissioner, Michael Mendoza. <br /> Mr. Tom Bunker, of BSS Design represented the applicants for this project. Mr. <br /> Bunker said it's a non-conforming structure. The rear setback is 12. 9 ft. instead of 15 ft., <br /> and the set back from the wetlands is 36 ft. instead of 50 ft. The proposed work is in the <br /> front of the house. It's a small addition that consists of 16 sq. ft, The floor plan shows that <br /> the project is to square off the kitchen and take a part of the existing porch. The street view <br /> shows they are adding 3 ft. 9 inch wide with a one story. This is keeping with the character <br /> of the neighborhood and is well within the lot coverage standards. <br /> The Board had a conversation regarding the bylaw regarding pre-existing, non- <br /> conforming conditions. <br /> Mr. Goldstein read the Conservation Department and Board of Health comments <br /> into the record.
