S) <br /> (Map 117 Parcel 312) Plan No. 11408-H (sheet 4) <br /> Mashpee, MA 02649 <br /> A Petition was filed on March 24, 2017 by Ellen J. Harris requesting a Variance to <br /> allow for a shed to be placed less than one foot from the rear and side yard setback under <br /> §174-31 of the Zoning Bylaws on property located in an R-3 Zoning District, and <br /> Popponesset Overlay District, 41 Greenwood Road, Map 117 Parcel 312, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpce Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on April 7, 2017 and April 14, 2017 a copy <br /> of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the.Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, May 24, 2017 at which time the following members of the Board of Appeals <br /> were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board <br /> Members Ron Bonvie,Dom DeBarros,and Scott Goldstein, and Associate Members,Brad <br /> Pittsley, and Norman J. Gould. Also present was Michael Mendoza, Building <br /> Commissioner. <br /> Ellen Harris and her husband, Mark Toomey returned as requested by the Board <br /> from the previous hearing on May 10, 2017 with a revised plan for their proposed 6 ft. x S <br /> ft. shed. The revised plot plan depicted that the shed is now 3 ft. from the boundary line, 6 <br /> ft. from the house, and 17 ft, from the boundary line off Greenwood Road. The shed will <br /> be aligned with the neighbor's shed but 3 ft. from the property line. The property is <br /> currently under construction for their approved raze and replace dwelling project. <br /> Mr. Bonvie read the Conservation and Board of Health comments into the record. <br /> The Board had a discussion regarding the placement of the shed. There were no more <br /> comments from the Board or audience. <br /> 1 <br />
