Babineau Page#: 265 <br /> 27 Monomoscoy Road West <br /> (Map 114 Parcel 18) <br /> Mashpee, MA 02649 <br /> A Petition was filed on by Owners, Steven and Christine Babineau request a Special <br /> Permit under§174-25 (I) (9)of the Zoning Bylaws to reconstruct an existing licensed dock <br /> and additional guest parking on property located in an R-3 Zoning District, 27 <br /> Monomoscoy Road West, Map 114 Parcel 18, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on April 7, 2017 and April 14, 2017 a copy <br /> of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 26, 2017 at which time the following members of the Board of Appeals <br /> were present; Chairman, Jonathan Furbush,Board Member Scott Goldstein,and Associate <br /> Members, Brad Pittsley and Norman J. Gould. Also present was Building Commissioner, <br /> Michael Mendoza. <br /> Mike Borselli, of Falmouth Engineering represented the applicants for the petition <br /> to reconstruct an existing licensed timber walkway on the property. He gave a brief history <br /> that the former owners secured a Chapter 91 interim permit, not a Chapter 91 license but <br /> the interim permit which has a more simple streamlined permitting process to allow <br /> existing docks to become licensed as a permitted dock in the Commonwealth of <br /> Massachusetts. He said when you only obtain an interim permit, a condition of the permit <br /> must be converted to a Chapter 91 license within one year of title transfer. The license runs <br /> with the land, the interim permit does not. He said when and if this is converted into a <br /> license, which is the goal, any future property owners deem the benefit of the license for <br /> the dock. <br /> Mike Borselli said that his client would like to obtain this license but the dock is in <br /> disrepair, the posts have lifted from ice, and the decking is old. He said his client would <br /> like to rebuild in the same footprint, and believes he can receive a permit for the dock. <br /> 1 <br />
